If the rent is normally paid on the 1st of the month, I think you'd do a pro-rated thing. I'd just make a fraction of 15/30 and reduce that fraction to 1/2. Therefore, the tenant would pay for 1/2 month's rent.
Certainly you can look up what the law says for your state, but that's how I'd do it mathematically. As a tenant, that seems fair to me. |

30 days notice means that if notice is given now, and the rental period is from the the 1st to the 30th or 31st, then the tenant has givern a 30 notice for the period ending September 30. If the rrental period is week to week, a 7 day notice is required. You are entitled to September rent. However, you are required to make an effort to rent it by the 15th to mitigate the tenant's loss. Usually this does not happen, but if some one wants to move in early, and he pays you a few days rent for part of a month you must reduce the previous tenant's liability by that amount. |

Actually, it depends on your state's landlord tenant laws.
If your state requires that the notice coincide with the end of a rental month, then you are entitled to the full months rent for September. Your tenant's notice would be faulty. It would not go into effect until the next rental due date - September 1st and the tenant would remain liable for the rent through September 30th.
You would only have to return prorated rent IF you had another tenant move in between September 15th-30th. Most states fall into this category.
If your state allows the notice to be given on any day (literal 30 days), then the tenant would only owe rent through September 15th. California is one state that allow this. |

IF he gave you the notice today, today is the 19th. HE owes you through the 19th of Sept.
YOU must refund money not earned for the 20th through the

well it depends on where you live. Most landlords ask for 2 months rent at the beginning of the lease. If you didn't then he should be paying a portion of the month. Most good landlords give them a break. |
