My tenants will not vacate my flat even though i gave them 2 months notice - what can i do?

I tried being nice to them but they won't leave - the tenancy is up on the 31st May and I want them out. They said they won't go until they find somewhere else. its costing me storage fees and if i go to court to evict - how long will that take? Also i have now been told that i needed to serve the notice in legal form not a typed letter (which I did with all needed details) - that should suffice should it not?

in order to legally evict them u need to serve them on official court approved papaer, call ur rental court to find out the exact letter head, u can get it at staples or whatever office supply stores u have available to you. you cannot serve them legally, someone of a third party (your friend, a police officer, etc) must serve them. i recoommened a polic office just to scare them. after you serve them with 30 days notice, go to court and file a legal eviction process, they have 15 days to respond then it goes to court, etc, it takes about 3 months for them to be formally evicted and for a sheriff to officially chaneg the locks and kick them out. the bad part is you will have to wait this long. so the best thing i can suggest is to keep asking them to leave. serve them formal paper work, and be firm in stating that you will sue for every penny they owe you, good luck!

If a person is recieving mail at that address, then you will have to go through the court system to get them evicted. Perhaps they know that you can't just tell them to leave and thats why they haven't left. Then you can make sure that they pay the court costs.

it is correct you needed to give them the notice using registered mail.....then you have a time frame...but if there lease is up may 31st then you can go to the local magistrate and they will help walk you trhough the steps you need to take.

Hopefully you put the two months notice in writing and had them both sign it. if not , not sure what to tell you. except get the authorities involved.

Turn off all the utilities and call bubba and bring the shot gun and through them out..... It worked for me...

Go to Court and get them EVICTED, where the sheriff comes and throws them out physically. Trepassing charges will not work if that is their address, cops will say it is a civil court matter.

if you go to court you will have to file an unlawful detainer - before that you will serve them with a 3 day notice and if they don't move out you will attach that to the complaint on the unlawful detainer - once you file and they have to get personally served they will have five days to response (if you're in CA other states may be different) if they don't answer then you have to file a default and then have the Sheriff's services move them out. May take about one month to get the whole process and them moved out

Hi, a lot depends on where you live. I live in VA, and it can be quite difficult. First if you really want them out, do NOT accept one cent in rent money. In Va to evict someone, you can not have received any rent in the past 30 days. You also need to send them an eviction notice. I print my off of an on line company called rentalincome.com. I take a news paper with the front page, tape the notice to the door, with the front page of the news paper next to it and take a photo, that will help prove the date you delivered the notice. Then you must wait 30 days in VA, then if they have not left, you must go file for a court eviction. This whole process usually takes around 4 months in Va. I wish you luck. The laws are aginst the landlord.

I you send it to them by registered mail it's as good as any court papers. Then call the police and have them throw them out. Then file one of those things where they can't come within 100 yards of your dwelling, or you. Once they cross that line, send them to jail and they will have a nice free place to live and eat.

You have to go to probate for an eviction order. The marshalls may have to come.

Have the police remove them. Simple as that. Show them police your proof of ownership, like your Deed to Secured Debt, and explain the situation. They are now trespassing.
