Just state the facts and stay calm. Also list the consequences. If he is not happy because of all of the "problems" in the rental property tell him that he has thirty days to find another residence. You have bills to pay. I have a mortgage. We have to pay, bottom line. No one lives for free. Best of luck. |

You are going to have to put your foot down because the longer you keep allowing it, the harder it will be once you go to try to enforce something. Start serving them notices when they are late, demanding payment or that you will start eviction proceedings and/or late fees, if it is in your original contract with them. I hope you do have a contract. Review it and see what you told them regarding being late. You need to check with your local government to see what your rights as the owner are. Good luck and learn to be firm! With the economy as it is, things may get worse before they get better! |

The rental agreement between you and your tenant is your first line of defense. You need to have an agreement that spells out all of the terms of tenancy. Then you need to strictly enforce those terms. Letting people slide on the rules just sets you up for headaches down the road.
I like to include a late fee in all my rental agreements (make sure it follows the Landlord/Tenant laws in your area). I have also offered what appears as a discount on the monthly rent if paid before a certain time. For example the agreement might say something like "Monthly rent is is due and payable on the 5th day of the month in the amount of $750. If the rent is received on or before the 1st day of the month the amount due is $700. Good luck! |

Since you have a pattern of accepting late rent you need to give your tenant a 30 day notice stating that you are strictly enforcing the terms of the lease, specifically rent payment and due date. Have your tenant sign a copy of the letter proving he rec'd it.
If you gave him the notice this month it would become effective April 1, 2008.
On April 2nd deliver the eviction notice required by your state. Do not accept partial payment or your eviction is shot and you'll have to start over the next month.
Tenants are not allowed to withold rent due to repairs. The proper procedure is for them to deposit it with the housing court in your area. If they do not do this, then their repair claims will have no merit in court, especially since they sound trivial. |

Tell him than if he continues not to pay rent in time, you may have to terminate the tenancy so that you can find another tenent. The next month if he still give excuses, give him the official notice. |

Post a Notice to Quit or Pay Rent....most states have this as the first step....either 5 or 10 days.....google your state and landlord/tenant laws......
also the next time you rent to someone....make sure the due date is the first CALENDAR day of each month and more important time of day.....and late fees kick in six minutes later....that way you don't sit and wonder at 8 oclock at night if the rent's gonna show up......
Most tenant laws don't allow tenants to w/hold rent or deduct rent w/out giving landlord written opportunity to fix it first!!!
The Notice to Quit starts the legal clock.....get going! |
