My tentent asked if she could stay until after the holidays and not pay full rent because she can't afford it?
I am renting a house out for $1400 to a couple. They had a 12 month lease that ended October 1st and then the lease turned month to month. The lease also says I need 90 days notice before they decide to leave. They split up. The man gave his 90 day notice on September 13. This means they have until Dec 13th to vacate the premises. She, however, did not sign this notice and she has two kids. She just asked me if she could stay until after the holidays and if she could just give me what she can afford until I find another renter. She said this because she thinks it is helping me out and her out. Shje thinks even though she isn't paying the entire $1400, at least she's giving me something towards the mortgage and the house isn't sitting there vacant. I asked her how much she can afford. She said she is on disability and only makes $800 a month. This means she can only give me a few hundred bucks a month - if that! What should I do? Let them stay or tell them to be out as planned by Dec. 13? Also, is there any legal reprecussions on my end because she didn't give her notice to leave? Can I legally kick her out Dec. 13? They both signed the same lease.

I would contact a RE attorney where you are.

You need her to leave, you will never get rid of her if you let her take advantage of you.

If they are still married his notice should be her notice, but make sure your bases are covered.

I do not know where renters get the idea that their leeching off of you "helps you out" in any way, but it is not uncommon thinking. I had a renter actually come to court and explain to the judge that he should live in my house rent free simply because "I will treat it as my own".

You do not say what state you are in.

No! Do not allow her to stay without paying the full rent.

If both tenants are on the lease, regardless of which one gives notice, they must all vacate by the termination date - it is covered under joint and several liability. One notice is valid for all tenants & occupants.

The day that rent is not paid in full, issue the proper Notice to (Pay or) Quit and follow through with eviction.

She would be the only one benefiting from her proposed situation.

If she is not out by the termination date, file an eviction - she no longer has the right to occupy the rental.

What is up with some people?!

Your rental is a business. Start the process NOW! Otherwise, you will be sucked into this thing for months and thousands of $$$$.

If she cannot pay the rent, find a way to politely inform her that she will not have a place to put the Christmas tree and gifts she intends to buy with the money she isn't going to pay you. As sad as this is, the woman needs to learn that a roof over her head is more important than holiday accessories.

She's not doing you any favors here. Follow the law relating to whatever you need to cause her to vacate by the assigned date.

While it would be nice to let her stay without paying the full rent, you open yourself to a whole new can of worms by doing so. If she can't pay the full rent tell her she'll have to look elsewhere.

It's a business decision that needs to be heavily thought out by you. In all reality, although her situation is sad, you have a rental property for rent, not out of the goodness of your heart. Can you call the County Tax Collector and tell them you do not have enough money? Uhm, NO.

She may have points about another vacant house; However, I wouldn't feel guilty about whichever way you chose.

Perhaps give her till January 1 for the good warm fuzzy feelings, then try to get another tenant in there. If you want to prolong the inevitable eviction, tell her her tenancy will be continued on a month-to-month tenancy and once you find a tenant for 12 months, she will need to leave.

Her 12 mo. lease has expired and is on month-to-month. If she doesn't keep up with her monthly payments, it's up to you to tell her to move or allow her to stay. It's your property!

She may be right to a certain degree about the house being vacant and something being better than nothing. How long will it take you to rent it out? A couple of months? Ask her if she can maybe get a roommate (with a signed lease agreement of course). Or, have her put in writing that she will allow you to show the house to prospective tenants while she is still there. The other consideration is; can you afford to give her a break? If so then do it and be sure she puts in writing her intent to give you a certain amount of money and vacate the home by a certain date.

well u could get a evection notice and she could fight it iv seen it happen where they let them stay becaus they have kids but it all depends on you if it was me knowing she had kids i would let her stay wouldnt you want someone to do that for you if you was in her situation
