David C | My wife decided to sell our house, but I think it is a bad idea. She is going ahead.? |
We are joint owners. I was the one who paid for it, and sole earner. I don't want this to go on the market and I told the broker my wife contacted that we would not sell. I have just heard that the broker is putting it on anyway. How can I stop this? |

The previous answerers are correct, she can't sell it without your consent. But on a personal level, while I realize that there are many little "pick your battles" moments in a marriage, THIS IS A BIG ONE WORTH FIGHTING. So man-up, and hash it out. Good luck! |

if both your names are on the deed, one person can't sell it - and you would be losing a ton of money right now - if you aren't moving to another place for a new job, it makes no sense to sell a house now. - call the broker and tell him you will never agree to any deal or offer made on the house (which will likely be low given the current marketplace) |

If both names are on the mortgage and deed, it cannot be sold without the agreement and signatures of both parties. I would call the real estate agent back and let him/her know that you have no intention of agreeing to a sale and that any further attempt to sell the house will be reported to the realtors' association and the state's attorney general.
If the agent persists in listing the property, you could file in court for a court order to stop his/her efforts. |

Refuse to sign any contracts or offers. We had to have everyone on the mortgage & deed sign the listing contract. |

You are joint owners- SHE CANNOT SELL with out your signature. Call the broker again & tell him that you will not sign & he needs to remove the listing or you will report him.
The same would apply if you wanted to sell & she didn't - you would not be able to sell without her signature. |

is deed in your name. if so do not sign any papers. tell broker that you will not sign any papers. also if wife signs your name call police. |

Are you guys serious? Don't sign anything. Notify the agent in writing the house is not for sale. Put a block on the agent's phone number. Take down any sign that appears.
And get marriage counseling |

Like the others said, call the agent and tell him you insist he does not list it. Follow that with an email (traceable). If he does it anyway, contact your state's real estate agency and report him. The email is hard proof you told him not to.
I think your wife is wasting her time... and the Realtor's time.... and the Title company's time... and a prospective buyer's time....and the buyer's agent's time....and... |

i think it is more than having marital troubles. your wife is probably afraid of the current market and wants to jump ship. talk with her, find out what is causing her to tick in this way. She is probably testing you becuase the realtor needs your signature or hers with a power of attorney over you, acting on your behalf, just to even list the property, no realtor is going to list it anyway.
Consider for a second if you are having problems in your marital union. It may-possibly-I'm not an expert -be a sign that your wife is ready to cut ties. If thats the case, if you were the one who paid for it and sole earner, she should see a problem in letting you keep the house for yourself.
I think your wife is simply stressed and you need to talk to her.She may be simply wanting you to do something to reassure her that you got this. |
