NOTICE TO PAY RENT OR QUIT-makes no sense. EVERYTHING else was verbal. How long do we have with NOwhere to go?
Rent is $500mth. Have Recpts. Gave $250 deposit around Nov 1 and moved in Nov 19. Paid $500 first week of Dec. In Jan, we had a medical emergency in the family and mutually agreed to pay ("No problem. You take care of your mother first. I completely understand.") $200 first week of Jan. and $300 in mid Jan. We did so. We were unable to pay in Feb. On Mar 5, took her $400 (which was for Feb). Then on Mar 9 paid the other $100, catching us up to March, & gave her $90 towards Mar. While intoxictd, issued Notice to pay or quit. Date says 3-___ -08 (day was blank)...we are to deliver said premises on or within _4_ days...due to nonpayment...in the amount of _one_____ dollars (left out what she thought should've been the word thousand), where you can write in parenth, wrote _$1000_. In the space after wrote. There's a $25 late fee per mth & you are 2 mth behind. So you owe $50 for 2-1-08 to 3-1-08...Reinstate if payed in full by 3-7-08. Offered$400 so we could stay til end of mth."NOPE! OUT"
Additional Details
The verbal agreement was that rent was due the first week of each month.
Nov1- $250deposit.
Nov19- Moved in. Made an agreement that she would supply materials and they would furnish the labor for various repairs to the property to cover the remainder of Nov.
DEC-paid $500-on time.
JAN- after mutual agreement, paid $200+$300-on time.
FEB- paid $400+$100 1mth late
MAR- paid $90 2 days late. Tried to pay remainder that was due Mar 7, of $410, on Mar 12. Unfortunately, when tenants arrived with payment landlord was extremely intoxicated and issued a half filled out notice that doesn't make much sense. Deadbeats? Maybe so, if 5 days late makes you that. But does anyone KNOW if Missouri has the 30 day law or are they homeless? They have tried to pay the remainder and would just as soon be rid of the whole situation by moving asap but, we all know it doesn't happen over night. She's now threatening to throw everything in the street while having them physically thrown out. Today!

Landlord is obviously fed up with you payment schedule. Paying tenants are easy to find...none paying tenants should be pushed to the curb. Grow up and pay your rent. Landlords have bills to pay too...they are not in the business of supporting deatbeats.

at anytime a landlord can decide to throw you out if your rent was not paid on the day it's due. i think you know you were wrong but are trying to find little things to stay there. you owe her money and shes tired of waiting for it. how would you feel if you got paid the 1st and 15th of every month and your boss would pay you the 10th and the 25th? you would be pissed!

Honestly, and Im not just saying this to be hateful... i would kick you out too. having someone who can never get it together and pay on time is a pain in the butt. once or twice is understandable but you seem to have issues ALL the time. At this rate you are going to get kicked out of every place you live.

The pay or quit is just the first step, failure to pay the monies on the due day or move from the premises means then the landlord can proceed with an eviction

next step is a court date, this can be anywhere from 10 days to three weeks, on the court date you either pay the monies or an order is issued against you

next step is to take that order to sheriff office who will make a date to come out and remove you from the rental that can take anywhere from a week to a month

Your question was not clear but if you are late on rent and she is evicting you I think she is in her legal right.

PS all the people telling you that you have 30 days are wrong. There are several states that only have to give you a 7 day notice and a few that only have to give you 48 business hours.

Yup next time pay, I have no sympathy for people who don't keep up with the rent as my dad is a renter, just because they have a house to rent doesn't mean they can afford to have other people's problems as well, and they will usallly have a moragage on that house you are in

Can you blame them? You guys need to learn to budget your money better... You've been there 3 months and haven't paid on time at all and you are a month behind.

If you have been served, then she can bring the police to kick you out. If you are unsure of the eviction date, then CALL YOUR LANDLORD.

If there isn't a chance in hell of paying all, then go find yourselfs a cheaper apt or house and go ahead and move out.

depends on what state you are in. Renters have as many, if not more rights than landlords. You can probably stay in your place for another 30-60 days before they can physically come in and remove you and your stuff. Check your local renters rights for details.

first of all, her notice is not legally binding. the notice has to be notorized to be legal. if you have to go to court you are given so much time to move. its not an overnight thing. be looking for a new place.

don't be stupid and not get things in writing. Hope you got receipts on your payments! By law they have to give you 30 days to get out. Only YOU can protect you!

Your rent should always be a priority.Since you have gotten this far just stay and save your money. They have to get a court order to vacate and then hopefully you will have the money.This is happening across the U.S. but bad government has made this common place.
