Hi-I have a question...we had been renting a house for about two years when the landlord suddenly decided to sell it. He gave us a choice of buying it which we decided against because the home has serious structural and mold issues. Okay so we move out-he basically gave us a week by the way-and he lists the house on the market with his sister in law, a local real estate agent in our town. All of this was fine, although we were really hoping that the owners and real estate agent would be upfront about telling potential buyers about the problems and updates needed with the home. Anyway, I ran into a guy that I knew and he mentioned that he and his wife had looked at the home-they noticed right away the same problems that I mentioned above-He then went on to mention that he asked the real estate agent why we had moved out and she said that we couldn't obtain financing for the home! Very upsetting and completely untrue-what can be done? Can she lose her license...want to do something! Additional Details Gosh-thanks for the fast responses everyone-this is such a helpful site! I just wanted to add that this real estate has disclosed personal information about quite a few people-for example, my neighbor just sold her house and she, the real estate agent, was talking about how high this buyer's interest would be, financial issues and what not. She was disgusted as she just wanted to sell her house and didn't really want the details about who was buying it. And also...about a year and a half ago we had used this real estate agent to look at a few homes and she disclosed to us (naming names) about other potential buyers on the home that we were looking at they either this person or that person didn't really have the income for a bridge loan or this or that person couldn't obtain financing or didn't make enough money to purchase such a home. My husband was disgusted and so was I but this latest thing is enough to send us over the edge with this woman! Hope all of this makes sense... |

Write some letters to your local papers and try and get them to print something. Ex...letters to the editor.
If word gets out in the press that she is shady, no one will want to use her and that can be far more effective than any disciplinary action an employer could give. If the word of mouth gets bad enough..she'll either have to move or find a new career. Word of mouth is the most powerfull form of marketing your can get. And it can also be your worst nightmare! |

if you can get the person to sign an affidavit explaining what the RE agent told him, esp the fact that RE agent said the reason you left was based on not getting fiance,

Hi there, hv read wat happen. may I knw which country u from. There are many real estate agent are also very disgusted. So u hv to be very careful & selective. Many are ex-sale person/man, just like another con-man. Must be extra careful........ be very selective. Many are just sales man and hv no business ettic. Realli sad about this. I am also a agent and I am just a "new bird". Also being cheated by other agents....... so image, how scari the experienced agents are. They are so selfish, ill-hearted and wicked.... Its realli sadden me but i'll be strong & learn why. So ... i really hope u got ur new home and get over with such people on earth. Good luck! |

The real estate agent obviously told the guy you know that story as she was probably trying to avoid telling him about the problems the house has. I don't know if there is much you can do, but I would put a complaint in writing to the manager of that real estate agent and also call the REI and ask for their advice. |

You may be able to form a case of slander, where the agent stated untrue facts about you in a derogatory manner to the other couple. (That may not be the legal term, but then again I am not a lawyer) :)
There are very nice, honest agents, luckily I have found one, but I got ripped off by one on one of my first places who cooperated with the seller's agent to boost the price. She knew I could afford more than the asking price so she told the seller not to agree until I went higher. Its ok since the house is still worth a lot more, but you have to be so careful.
Good luck with this, in the very least I would approach the realtor or go to their manager in the office and let them know. |

I'm not sure if real estate agents and Realtors are the same thing, but the latter, if they belong to the National Association of REALTORS are bound by a code of ethics. You can report them to wherever they are licensed from and have them reviewed. You can also report them to the Better Business Bureau and your local Chamber of Commerce. Investigations by these agencies will not look good on her record and she could loose her license for misrepresenting your situation. If she is affiliated with a national real estate company(Century 21, or ReMax, for example)they may also have a contact place to complain about their agents, which, I'm sure they won't want someone representing them who is not totally honest. You might also check your local courthouse to see if anyone has filed a complaint about her. |

I think you are getting some good advice about complaining to the realtor's employer and the RE board. Don't sue her though. That is getting to be way too big of a problem in America. I'd say she deserves a severe reprimand from her employer and owes you an apology. I bet she'll watch what she says in the future. |

Report her to the local real estate licensing commission. Every state has one. Do a google search for your state name and "real estate licensing." Their website probably has instructions on how to file a complaint. She probably will not loose her license from this but she get a reprimand.
They will probably not care about her statement about you not getting fianncing. The key is to emphasize the house has structural and mold damage that a professional real estate agent should be able to notice from just walking around and that information is NOT being shared with potential buyers. When they ask how you know it's not being shared, then you an tell them about how she offered the untrue reason of your lack of financing. |

sure she can loose the license due to the fact there is a lot of information agents know that needs to be kept confidential. Instead of the threat factor- why not quietly talk to the agent and state what you have told here- tell him/her the next step is her broker- next step is a complaint filed to her real estate division if it doesn't stop. Trust me no real estate agent wants a complaint filed. Nice an quite- state your business, no arguments- ball is in your court- smile and walk away. |

No, not in this instance, the Realtor does not owe you any fiduciary responsibility, she owes it to her brother who we will assume has hired her to sell this property. Now, if the owner and the Realtor know about the mold problem and do not disclose this information to perspective buyers, this might cause a problem. But, if they actually sell the property and don't disclose the mold problem, this could be an even bigger problem and may be actionable. But making unkind remarks about a former tenant... nope, they can say whatever they wish.
