Need help with landlord dilemma?
My husband & I have always paid out rent on time. Last month was an acception due to an emergency. Now my landlady claims that we have bounced the rent checks for Aug. & Sept. She took our security deposit to cover Aug. rent and now she says that we owe her still for Sept. Out bank statement clearly says that the rent check for this month was paid. She was baligerant, nasty and told us if we didn't have $1200.00 by tomorrow we'll be tossed. I've had the crappiest day of all and this happens. She wouldn't even look at our bank statement to see that Sept. rent was paid. I don't know what to so, we've never been in this situation before and I really don't want to pack up everything and leave during the school year. We only owe her the $600 for the security dept. Please help and advice would be appreciated.

She did talk to her bank and Sept. rent was paid. Now she wants to come up here tomorrow to look around. My place isn't the neatest right now because my 1 year old daughter has been sick & I've let a few things go. I live in NY. Unfortunately she lives downstairs. I'm afraid to tell her that we need 24 hours notice so I can straighten up. I haven't stopped crying for an hour.

Stop sniveling. She doesn't have to look at your bank statement or anything else if she doesn't want to. You "really don't want to pack up everything and leave" ... well unless you are in the habit of doing anything that someone tells you to do, simply don't.

And all the certified letters in the world can't stop her from filing based upon non-payment if she really wants to, be it true or false.

She can't evict you without a court order no matter what she says.

After she files to evict you based upon non-payment, when you file your answer your defense is that the rent has been paid. When you get to court, you show your proofs and the case is dismissed.

If she applied your security deposit to August rent, that may be her problem and not yours. Did you get this in writing? She may have forfeited her right to the deposit by taking the monies out of trust depositing them in her personal account. It's called "commingling" and it is against the law in NY.

NY and NJ have some of the toughest security deposit laws on the books. If she commingled the funds by taking them out of trust and depositing them in her personal account, she may have forfeited the security deposit entirely. In other words, she may not be able to get another deposit out of you. There are other factors involved, like the number of units in a building etc so you will need an opinion from someone who specializes in Landlord/Tenant law in your area. The cost of a consultation will be well worth it.

Even if she didn't forfeit her right to the deposit, the notice procedure and demand for another deposit will take a while, which will give you the opportunity to save up the money if you have to.

If your daughter was sick and not you, I don't see what that has to do with the house not being clean. Is your daughter the one who does the cleaning? If not, tell your landlady you want proper notice before she conducts an inspection. That should get you another 24 to 48 hours. Toss everything in the closets and drawers if you have to. Stop crying and stick up for yourself! Tell her you won't consent to an inspection at this time, and tell her when you will be available (like Monday). You do NOT need to give her a reason. Your life does not revolve around her wants and her schedule. She doesn't have the right to just barge in whenever she feels like it. You aren't at her mercy so stop acting like you are. You are giving her power in your mind she doesn't have in reality.

I would be more worried about that bounced check than anything.

First, rest assured that tenant laws usually favor the tenant. Don't be afraid of what she is threatening to do. If she actually told the judge what she has done, the judge would probably penalize her and award YOU double damages.

Get all the paperwork in order. Copy her and send her a letter (certified) telling her that SHE is in violation of state law and your lease by .........(google your state and landlord/tenant laws) and you will find that she has to give proper notice to view the apt. and that she is purposely harassing you about bounced checks when she KNOWS they cleared her bank.

Most state laws are very stringent regarding how and when security deposits are to be used....She can't just willy nilly pull it and apply it to rent. However, you must make sure you are current (including late fees).

Don't be afraid of the eviction process.....You have rights...you just have to exercise them. If I were you, tell your landlord to request an expedited hearing - you'd love to tell the judge what has been going on.

Most states REQUIRE 24 hours notice before a landlord can enter a rented property, unless it's an emergency (like flood/electrical/heating problems). I'd check with your local municipal court/government to see exactly what your rights are as a tenant.

I had my eyes opened when I was an apartment manager -- The owner of the building wanted me to do a lot of illegal and/or unethical things, and I refused. It really pissed me, so when I could afford it, I stopped working for him. He tried to screw me out of our deposit, but I knew too much and warned that I WOULD go to court. I had my check in 5 days!!

She can't throw you out, this is a legal proceeding, in many states if she tries to do it herself, she is setting her up for a lawsuit.
She needed to have given you a printed document with a notice to pay rent or quit.
If you don't want to let her in, dont.
If you have time to talk to a legal aid society, do so.
She does sound like an unprofesional troll.

you may have to wait for them to take you to court. since they refuse to look at your bank statement. so get your paper work ready and be prepared to talk to the judge. GOOD LUCK! I'm sure he'll look and listen to your story.

That is horrible! All you can do is just exactly what you've done already. It doesn't sound as if she is willing to listen at all. Do you have a lawyer (cheap-but good one) and could possibly have him look this over and tell you your rights? I know you're probably not wanting to spend money on a lawyer, you've already mentioned that you owe $600.00. If she is not willing to hear you out and you feel that there is way too much tension here then maybe she doesn't need to be your landlord. Apparently she has taken you for someone that she can't trust to make these on time payments etc. You might be better off out of there and renting from an understanding landlord that is capable of having an honest renter like you. See if you can get a quick loan for the money owed and call it good. Best of luck to you and your family.

Most states have landlord tenant laws that govern the actions of landlords and renters in these situations. Most of these laws do not allow a landlord to simply toss you out in the middle of the month without adequate notice.

I do not know what state you live in, but I would start by writing a letter clearly stating your contention that the September rent has been paid and attaching a copy of your bank statement (make sure and cross out any information that could be used for identity theft) as proof.

If she still refuses to look at the evidence, send her a second letter informing her that you wanted to settle this in a civilized manner, but since she will not be reasonable you are going to hire an attorney.

What you are doing by communicating in writing is creating a paper trail that documents the reasonableness of your efforts for the court (should it go that far), and at the same time slowly turning up the heat on your landlord making more likely that she will settle.

Before you write the first letter, you might want to google the terms "landlord tenant law" and "eviction notice." If you find law favorable to your position, include it in your first letter.

there are legal procedures she has to follow. Send her a certified return receipt letter with your documentation of payment. Inform her if she continues harassing you, you will take her to small claims court. In the meantime, look for another palce as soon as your lease xpires. She sounds like a real b#$*%! Security deposits are not to be used as rent...however, in your case, she may give you a hassle about returning it, so I would use it as your last month's rent.

The terms of your "Lease Agreement" should state the rights of the Landlord and the Tenant regarding late rent payments, i.e. a penalty of $25.00, but with a grace period of 5 days. Read through your Lease Agreement.

If the tenant violates his or her obligations, for example, by failing to pay the rent, the landlord may terminate the lease through eviction proceedings. The action by a landlord to remove a tenant from a rental unit is known as an eviction or an "unlawful detainer." Some local housing codes define "just cause" for an eviction and outline procedures that must be followed.

In an eviction based on nonpayment of rent, a tenant may assert any claim for money owed the tenant by the landlord. The tenant's claim (sometimes known as an equitable defense or setoff) must be related to the tenancy, such as the tenant's payment of a gas bill that was the landlord's responsibility under the rental agreement. In eviction actions strict rules and procedures must be observed. Generally, a legal eviction process involves:

* Proper notice. Before evicting a tenant, the landlord must serve the required eviction notices using proper procedures.
* Filing of a lawsuit. If the tenant fails to move out, a lawsuit must be filed to evict the tenant.
* Entitlement to a court hearing. If the tenant disputes the reasons for the eviction, the tenant is entitled to a court hearing.
* Sheriff's involvement. If the tenant loses the court hearing, the sheriff would then be ordered to physically evict a tenant and remove the property in the unit. Only the sheriff, not the landlord, can physically remove a tenant who does not comply with an eviction notice and only after an unlawful detainer lawsuit has been filed.
* Liability for attorneys' fees. In an eviction dispute, the successful party is entitled to recoup costs and attorney fees.

Prohibited Eviction

Landlords are generally prohibited from locking a tenant out of the premises, from taking a tenant's property for nonpayment of rent (except for abandoned property under certain conditions), or from intentionally terminating a tenant's utility service. Various penalties exist for violating these protections.

Retaliatory evictions are also illegal. A landlord may not terminate a tenancy or increase rent or change other terms of the rental agreement to retaliate against a tenant who asserts his or her rights under your state's local Landlord-Tenant Act or s tenant who reports violations of housing codes or ordinances. Call your local Attorney General's Office to obtain details on your rights as a tenant. Additionally, your Landlady is completely out of line by refusing to acknowledge payment of September's rent for which you may have cause of action against her.

Check on-line for your states" landlord tenant laws". Most states have laws regarding the 24 hour notice to enter. I would suggest you leave her a note & put one on the door explaining that you do not want her to enter and for her to please reschedule her inspection for another time allowing you a 24 hour notice in writing so that you can make arrangements to be present during the inspection. That will buy you some time. She can not enter unless its an emergency or proper written notice has been given. If she works for a management company or owner I would call to complain to them and follow up in writing regarding her unprofessional behavior. I have managed buildings in California for 20 years and I can tell you, her behavior is unacceptable.Check with the housing authority also, you may be able to get some info or file a complaint with them. Regardless, if she threatens you with eviction, there is a legal process and you can go before a judge to prove your rent is paid and you are being harrassed by her, don't worry. STOP speaking to this woman. All discussions should be in writing starting yesterday. Sometimes we run at the mouth and screw ourselves.

Unfortunately, some landlords think a lease is only to protect them. NOT TRUE.

I had a landlord (from another country) who put the house up for sale 8 months into the lease. I found out only by finding a for sale sign in the yard when I came home. Long story short, I got a crash course in law. There was NO provision in the lease for them to be able to sell it, show it, etc. But guess what? A realtor shows up with a client while I'm in the shower one day. I was livid.

We won that one because the law was on our side. I was also able to get the listing agent in trouble for lies he posted on MLS about the listing.

My point is, you are not helpless and at this wrenches mercy.

GET PISSED AND FIGHT!

If you have documentation that the check for Aug. & Sept. did not bounce, send it to her in the form of a certified letter.

Depending on the laws of your state, she can not take the amount due from your security deposit.

In order to evict you, she will need to file with the county court and you will have the chance to offer an explanation of facts.

If you do not want to move and made your payments, you can fight her and win -- just remember she will continue to be your landlord and my take it out on you in another way.
