recently i rented out a hyome i own to a gal who had no money to pay the security deposit. the house was dirty from last tennant so we agreed that she would clean the house in lieu of paying the security deposit. now she is moving out and expects me to give her 650.. which is what i normally charge for security deposit. i think she's wrong to be asking. i mean all she did was clean the house so she could move in i supplied everything. what do you think i should do. |

Legally I dont think you owe her a damn thing.
Here is my issue. You said you dont have to pay a security deposit since you will fix the house. So she spent her time and money to clean it.
A security deposit is to make sure its in the same condition that it was when she got it. Is it?
I think you pay what she can prove she paid to clean it up. And I think most laws in most states will agree with me. Ask for receipts. And pay what she has spent. You never should have done that. |

I would check out the laws in your area before you begin to do anything. Personally, you should have actually written out a contract that specified this situation when you agreed to let her clean as opposed to the deposit. I would say that you don't have to give her anything, but I'm not a lawyer. Check it out with a lawyer. Better safe than sorry. |

What a mess! I would try to work this out. Estimate how much someone would have charge to clean the place...maybe even call some cleaners and get some written estimates of what it would cost to have the apartment cleaned. It will probably be a couple hundred bucks at most (depends on how big this place is). Offer her the amount. If she you did the best you could to resolve the situation. |

You owe her nothing, but then she doesn't owe you a property any cleaner than you gave it to her when she moved in. Let it at that, unless you somehow feel obligated to pay her $650 for cleaning the house. |

next time be a better landlord and take care of your asset by getting a good qualified tenant )good credit) and a months rent for deposit (certified funds only) and first months rent in advance
check out credit, employment, employment and rental history and criminal and check writing history.
don't listen to the sad stories tell them to move on, there are to many good people needing a place to live.

If you guys made an equal trade (she gave you her time and hard work cleaning and you didn't make her pay a deposit) then I don't understand why she would want money from you that she never paid. Is she feeble-minded or something? Just explain to her that if you don't put a deposit down, then you don't get anything back. If she STILL doesn't understand, then tell her to produce a receipt and then you'll talk. |

I can see both sides of this. You have now learned a lesson. You can not be nice to any perspective tenants. Its a business. She should be grateful that you gave her an apartment when no one else would. Since there wasn't an agreement that she would receive x amount for cleaning the apt. I would tell her to pound sand also. |

Well, If neither of you have anything in writting then neither one would be entitiled to monetary compensation.
You owe her nothing . Cut your loses .. say goodbye and next time don't make sure you get everything in writting and also get the security deposit .
