Need to break my 1 year lease immediatley. I really really need help?
Lease was effective July 1, 2007. Me and my fiance need out of there immediatley due to us getting sick from the foul odor of the place and the hell on earth neighbor upstairs. I'm going to my attorney today but I don't think we have any rights. Should I call my landlord and ask about breaking the lease first? and if I do can he decide to do horrible things to us and make us stay there? I know we might get sued and I'm prepared for that. I just don't know if I should call him first.

First off you need to check your state laws, it varies, but most of the time you have 30 days after moving in, which you are well within. Also, you need to check your lease hard...is it with a person or a complex, but no matter what a rental agreement does NOT cancelout the law, if the law says you can move out in thirty days...you can move out within thirty days. There is usually a 'breaking of the lease fee' - if it's that bad, I'd just pay it and move on.

Foul smell? you have the right to live in a sanitary enviroment. You dont need a lawyer and don't speak with a attorney. Do this

1) write a letter to your manager and send it certified mail to prove they recieved it. write about the foul stench and how its unlivable. anything else would help.

2) call your state health board or anything Gov't and ask if you have a tenants advocate program in your state, they'll tell you what your rights are.

There is a way to legally break your lease. Find out where the stench is from and claim unsanitary enviroment.

Why dont' you think you have any rights? If your landlord is failing to provide you with an appropriate place to live, you have the right to get out of your lease. Talk to your lawyer.

You have only been in the lease for 5 days now. Hopefully there is a clause somewhere stating that within a certain amount of days you can get out. I would go ahead a get the attorney just to be on the safe side. Hold him in your pocket but go ahead and ask your landlord if you can get out. Take pictures of anything in the residence that is not right!!!

Have your attorney draft a letter that states you will be paying rent at the local court house. This means you have to pay your rent in full and on time, but the apartment can't touch the money until the situation is resolved.

have you brought the odor and idiot neighbor to your landlords attention?

if so and he has done nothing to correct the situation you may not have to pay anything .. it will all depend on the terms of the lease and what area of the country you live in (laws vary) .. check with your lawyer

yes call the landlord. tell them about the smell and the bad neighbors. they cant fix something if they are unaware of the problem. if its not resolved to your satisfaction, consult your landlord tenant act for your state

You should have right to move out if the situation cause health problems.

Unhealthy & Unsafe Conditions----

Sometimes rental units become unhealthy, unsafe, or unlivable due to a landlord's failure to maintain the property. It would be wise to get legal advice to learn if the tenant is able to legally abate (adjust) the rent. A lawyer may indicate how to document the condition, what agencies to contact, and what should be put in writing. If not done legally, rent abatement could result in eviction.

If conditions are so bad that tenants feel they can no longer safely live in a rental unit, a lawyer should be contacted before the tenants officially move out to prevent further financial obligation.

Let the lawyer contact him/her and they can get this taken care of. You most likely would be told No as the landlord was aware of these problems when he/she had you sign lease. If no action is taken - call police about noise and health department about smell and document these and after three times, then sue and you can own the building.

The best thing to do is make sure you make every effort to speak to your landlord. The place must have smelled before you moved in and signed the lease so your stuck there unless it's a health violation. They may let you off the lease if they can find someone. Write a letter to the landlord and give them a chance to rectify both situations if you cant get a hold of them send the letter registered that way they will have ot sign for it. If they fail to respond verbally or with action you may have a way out of the lease.
