If you have a contract in place, they are not going to cancel the listing so you can list it with someone else with a very good reason.

Most listing agreements DO NOT state that if you sell the property within the original listing period that you still owe the original broker the commission....what they DO state is in the event that both parties cancel the contract, the ORIGINAL broker is entitled to their commission within so many days of cancellation or contract end date (usually 30 to 90 days) UNLESS the home is RELISTED with another broker.

THAT is why they aren't going to be quick to let you out of the contract.

If you have a binding contract with an Real Estate company they have the right not to cancel it. They normally would cancel it anyway, but they don't have to.

You have a right to restrict the showings on your house if you want because it is your private home.

If you have asked them to cancel and asked their broker and corporate office and they still say no, you may be out of luck.

Take your listing agreement to the new broker and let him look it over, all he can really tell you is if the current broker is doing what they say they would and you are getting showings and they are advertising the home then they don't have to release you from the agreement. If the new broker tells you other wise then he is not being up front with you and you shouldn't use them.

You signed a listing agreement, which is a valid, enforceable contract for a set time period.
Generally it cannot be unilaterally cancelled by one party without the other's permission during the term of the listing agreement.
Your new realtor knows all this, and how to go about smoothing the way for cancellation. I'd wonder about them before signing, check them out carefully.
All that said, frequently a realtor will cancel a listing agreement upon written request of the home owner, but they are not required to do so. Your contract is with the broker, so you need to take the time and go see the broker face-to-face to see about getting out of the listing. Be conciliatory, and thank them for their services. They have spent money listing your property and gotten nothing for it, so they won't be happy about this.
Remember you are NOT in a position of strength--you are reneging on a valid signed contract, upon which they have expended effort and money.

You need to review your listing contract. What part of the contract has the Agent failed to perform? Once you have that answer, you should call the Agent and discuss it with him/her and if necessary the broker. Perhaps it is a misunderstanding that can be remedied. If it cannot be remedied, and you still want to cancel, you then need to negotiate with the Broker to get out of the contract.

A listing is a service contract. Unless the contract specifically states what penalties there will be, the contract can be voided by listing why you are no longer satisfied and mailing it by registered mail, return receipt requested. There are many reasons for not being satisfied - not being available, not returning phone calls, failing to confirm appointments, not being available to other agents for information, not performing OPEN HOUSES, advertising, etc in an agreed way and so forth. Personality conflicts can make it difficult or impossible for either side to perform their contract requirements satisfactorily.

Again, unless your contract specifies the terms and penalties the contract can be voided with proper notice. The original agent is still due their commission if a buyer that he/she has shown the house to within the last 60-90 days buys the home during that period, he is entitled to his commission.

Before wasting your money on the lawyer, speak to the local Realtor Association. They may be able to expedite your request easily.

Most listing agreements state that if you withdraw the listing, then sell the property during the original listing period, either by yourself or with an other agent, you still owe the original broker their commission, unless they are the ones who breach the contract. It may be in your best interest to stay with that Realtor until the contract expires.
