I guess you can only pester your municipality, or city. It might take a little work, but you have to remember that they are the only people who can really inforce this. You could make your case a little stronger perhaps if you organized a petition and had your neighbors sign. It will probably make your complaint stronger. |

Depends on ur jurisdiction (state). In California, u can trim the portion of the tree that hangs over ur property, but u cant make the neighbor pay for it. |

Technically it is your neighbour that has to pay as it is his tree and any damage done to your property due to the tree is his responsibility.
Saying this, it is wise to ask your neighbour to only pay half of it, this will get you on good terms with them and future relations will not be strained... it may even help in getting limbs chopped in the future... especially if it later becomes your tree that hangs over their side. |

In my state I can cut anything on my property, but it's at my expense. It sucks because my neigbhor has a dead tree hanging over my backyard, and big chunks of rotting tree parts keep falling in my yard and I have to pick it up. In this state they are not responsible for anything hanging over the property line. |

No, your liable for what is on your side of the fence, any state. if allstate was smart they would pay for it, it would be cheaper for them now rather than for the branches to ruin your roof and then they have to replace that |

First get a letter from Allstate saying that you have to trim the tree.
then get 3 quotes from 3 different places on what it will cost to cut down the tree branches, be sure to get the quotes in writting.
Then contact an atterney to find out what the law is in your state, and see if he can send you a document telling the law, or if he knows a web sight containing the law in your state. Most lawyers dont charge for this. When they do it is a small fee, if you pay a fee be sure to get a receipt.
After you have done all of this, go see your neighbor, hand your neighbor a copy of each statement you have, and tell them your deadline to have it done, and ask them to review the documents then to call you so you can come up with a plan.
if that dont work, then call Judge Judy, and take them to small claims court to take care of the full cost rather then half.
Just make sure you obtain all this proof, because even if you go to court, you will need all these documents.
Or you can talk to the neighbors, see what they say, then go get all the documents. They might be pleasent about it. Bring them a cake or cookies when you go talk to them.
Say... Here i brought you this cake, also I was wondering if you knew any one that would be able to cut the brancehes off the tree that hangs on my side? I hate to do it, because it looks so pretty, but Allstate will not reinstate me until it is done. I even called a few other places, no one will give me insurance until it is done, they say it's a risk. I called around but the cost is to much, so I wasnt sure if you knew any one?

I'm pretty sure the law states that the part of the shrubbery on your property is your property so it would be your responsibility to get it cut down. You can verify this with an actual attorney, but I do know that if your neighbor had a fruit tree the fruit that was on your side of the fence would belong to you, so it would make sense to me that if you could reap the benefit you would also incur the cost. |

Depending on your situation there might be some options. Obviously, the first one is to talk to your neighbor, explaining that your concerned about safety issues. The next would be to go to your local govt and ask if they'll get involved. Occasionally, the building dept. or other governmental group may get involved. Otherwise, better get out the chain saw!
