Neighbour keeps parking his white van so partial access to my drive way is blocked?
Bought the house a year ago in a small courtyard of 8 houses and at the time the neighbour with the van was already here and parking his van on the road in the entrance to the culdesac, Raised it with the developer who said he wouldn't be doing it forever just until more houses were built. Well a year on he's still doing it but our complaint is he's moved the van down (probably only 5 feet) but it makes reversing in and general access to or driveway more difficult. Have said to developer (he still has 3 houses to build and sell) but got impression he was sitting on the fence and said we all have to live together. So we went to van mans house and asked if he could please move van further up as he's blocking our drive. We were greeted with you don't own the land and that type stuff but he agreed to move it which he has done for a week but now it's back to the same position.
Any suggestions as to what we can do without coming down to his leve? We live in Scotland.

In the US a simple call to the police will result in a tow truck clearing your drive way.

god parking wars are such a nightmare, we had the exact same problem turned quite nasty in the end.....
i would suggest you park your car in the space that he uses. and leave it there, failing that get your driveway extended, pricey but hell of alot stressful. good luck, no easy answer some people just have the brains of a rocking horse. x

Unfortunately unless he is blocking your access completely you have no legal rights. You just have to continue to keep your cool.

I completely sympathise. And it's very tempting to go on the offensive, but all that will do is raise your blood pressure.
If you can face it (and I KNOW it's hard), how about taking a couple of beers round to his place, sticking on a false smile and say "oi, matey, do us a favour and shift your wagon, please".
I mean, I would rather do the alternative and make his life as difficult as he is being with you, but ultimately, it just is not worth the time and energy. If you are matey with him he MIGHT...just might feel too bad to carry on being a git.

Call city hall bylaw dept . its illegal to block a drive way . A towing bill may convince him you mean business

Do you have a dropped kerb at the edge? If he is parking on a dropped kerb area contact your local authority and ask them who enforces dropped kerbs are kept clear and report him

Call your local highway department and ask them if you can paint yellow lines on each side of your drive way so you can have easy access to it.
If you can, then every time he parks past the line I would politely ask him to move the van. After a few times, if he fails to comply,explain to him you have no other choice but to call the police. I would also photograph the van in its invading position and make sure he see you writing down the time and date of each conversation you have with him.Also make a brief summary of your conversation with him. If he see you writing things down he may realize how serious you are about the situation. It might not hurt to have a witness with you when you talk to him. Lawyers and law enforcement love documentation.

Dont be hasty, he may have had no option, maybe someone else had parked carelessly. If it still happens there is not a lot you can do. I believe you have no legal entitlement to park in front of your own house, and it is just courtesy not to block neighbours access I dont think right of access applies. Try and be friendly with next door and tell rest of family to do same. Better all round if you are friendly, makes life pleasant.

If you want something done then dont let the builder get off site without him sorting it out. He could have something written into the deeds.

You would have to phone the police, you could try your local council but they would probably refer you to the police if it's blocking your drive.

go out at night, throw brake fluid all over the van, stab his tyres in the wall so they cant be repaired and dent and scratch every pannel, it wont be a write off and he will be pissed.
