Neighbours want us to remove fencing on our boundary so they can get access- Do we have to do so?
the people who own the plot of land next to us want us to remove our fence at the back of our garden to give them access. They have a right of access in the burdens of our property. The fence has been up 23 years since the house was built. There is a gate- but they have not asked to get in that way- but for us to remove fences and clear the ground. ( our garden!) They do not live there and have provided no reason for access. Does anyone know if we have to do so? We are in Scotland- so Scots law.

I would refuse them permission to remove your fence, it belongs to you. If they took it down without permission it would be a criminal act.
They have access to their land, through the gate. I'm sure there is nothing in the deeds that says it has to be certain size to get a vehicle on, for example. If there was, it would exist already.
My advice, sit tight and refuse, see how far they go with it. Have a solicitor look over your deeds.

In English Law - No. Here, right of access means that only - you cannot tamper with the property nor park, nor use it to have barbecues, nor as a convenient place to have a horse shod, etc., since their right of access cannot conflict with your enjoyment of your property.
Do you have the equivalent of Citizens Advice Bureaus north of the border? If so, and if I were you, I'd make an appointment to seek their advice.

You need to check your deeds to see what access and what land you are entitled to. If they are entitled to access then you need to consult a solicitor with a copy of the the land registry deeds and see what he advises. You may by law have to remove it, if it is denying them their right of access.

Scottish land laws are tricky. I don't think they have a right to this, provided the current method of access (the gate) is of a reasonable size/acessability to their land. FOr instance - do they wish to get vehicles through? Right of access is just that - they can trample over your land, but I don't think you are legally bound to help them.

they can remove their fence at their costs .
you can charge them exorbinate fees for access and damages to your property .
check with local lawyers/laws.

As there is already a gate, it doesn't sound very neighbourly of them! Maybe they have plans for the plot and want to get diggers etc onto the land?

you would be best to check the deeds or with your local council.

check your plans for the house if its your land then I think they can't have access unless you are willing to negotiate, and let them clear the land
