xinsirhc | New Landlord seeking advice on how to deny a pushy potential-tenant!? |
I am renting a house that is available at the beginning of next month. I have showed it to several people. BUT this one guy keeps calling and wants to give me wads of cash "now", wants to buy the house even, etc, etc. Just very wierd, and very shady. I have the feeling he wants to do something illegal with the house, or he is already involved with something illegal. He just doesnt seem up to par. But he calls me several times a day, and is very pushy. We are having an open-house for potential tenants this evening, and I am 100% sure he will be there with his pushiness.
My question is, how do I 'bypass' a tenant based upon my hunches? Is that legal?
Bottomline, there is no way I want to rent to this guy! How do I tell the guy that "im not interested in him"...is that even legal? I am concerned that this guy may do something, or turn me in for non-fair housing or something.
We do require each potential tenant to fill-out our rental applicaiton..

Just tell him you don't feel comfortable with him as he is pushy, and to please stop calling.. Now if he is a minority, you might be in trouble for that. I refused to rent to a guy once because he was on a motorcycle, and did not think his loud bike would be good for the neighborhood. Was a lot of grief, but not much he could do..
If he shows up at the open house, tell him to leave, as he has already made his offer, and you are not comfortable with him.. Once again if he is minority, you have a problem, unless you have someone else waiting in line. I have a clause on my application that allows me to pick between multiple applicants. |

Well, I can understand your "hunches"...INSTINCT will NEVER steer you wrong...more people should "listen" to theirs...
Since yes, it is illegal to not rent to someone without a valid reason...do you run credit checks? If not, you may want to start..with him..
You can always tell him his credit worthiness was not up-to-par and that you cannot rent to him, based on his credit score.
You do not need to be more specific than that.
However, should he persist, I think you speak with a real estate attorney...just in case. |

Firstly you can rent to who you want even if he is the only applicant.you don't have to rent to him. Ask him outright why he is so desperate to rent your property....the bottom line is this he does not have the say you do!..if you have a bad feeling about it don't do it, your hunches are probably right...i don't know where you are in the world but in the UK we can rent to who we want if we are private landlords.....My husband has his own property business and my daughter is a lettings manager at a nation wide property company that's how i have acquired this information....please go with your natural instincts if not I'm pretty sure you will have a problem tenant on your hands

Give him an application, and make sure that the person you rent to is a better qualified tenant than he is.
It's not illegal to be pushy, but if your gut is telling you that something is really wrong, then something usually is.
Have you tried asking him why he is so hot after this house? He may have a good reason, rather than the bad scenarios you are imagining.
I was very pushy when I went to rent my house, mostly because it was just a few blocks from my job and I was going to save a ton of money (around $250 a month) and time (over 2 hours a day) by not having to commute. I was all over my prospective landlords like white on rice. There was no way I was letting that house get away from me. Been there for years now, and they are happy they picked me. It worked out great for all of us. |

I dont think you would have to worry about that you obviously cant rent to each person that comes out so therefore that is going to be your best reason right there. After reviewing the applications you have chose a tenant and its not him. change your answering machine message to say the house has been rented at this time. |

Hi, as far as I am aware you dont have to let him move in if you don't approve. When me and my partner started to private rent when found a property we both liked but the landlord didn't want us to rent it as he thought we was too young, even through we were both over 18. I think if you feel this person is not suitable then just tell him, as it is your house after all.
He if tries to come to your open house then tell him he is not welcome and ask him to leave. |

It is very simple, as long as one of the other potential tenants are suitable, rent to them instead of the pushy guy. If he wants the rental so badly that he wants to purchase it, why is he renting in the first place? always go with your gut feeling, this guy is on the crazy side, just tell him "sorry the unit is no longer available" you do not owe him any explanation whatsoever! uh oh- good question. I believe with Fair Housing Laws, anyone that meets the qualifications and wants to live there...can. But I am not positive if private renters go by these same laws. I would think so.... a law is a law

if u suspect something illegal about him. ask for his ss# to run a credit report, bank statements, w2 form, pay stubs, employer check, reference check, previous landlord contact info etc. usually criminal dont have those info and will go away. i will be very surprised if he provide u those info. he would probably get the picture and go away. |
