thesmiths | Next door neighbor has vines growing into/on my property.? |
I would like the neighbor to remove since it's coming from her vine plant on other side of the fence. It's growing out of control and is climbing on my roof. I've been out of town for two months and just now found this surprise plant coming on my side... Is it her responsibility to remove from my property? If yes and she doesn't remove, can I bill her for having removed? |

you can cut back anything that grows on your property
you are responsible for the upkeep and maintenance of your own property, not your neighbor
you can not touch a single thing that grows on your neighbor's property |

 |
Have you tried talking to her to see if she's prepared to keep her vines under control? She may not realise that you are concerned about it. If she's not prepared to be reasonable, I'm sure you can take further action. Contact your local council because they will be able to give you more information. |

Just get your garden snipers and cut the vine that's growing over on your property. Why would you want to make such a big problem out of a weed! Come on, be a good neighbor. |

first you should tell your neighbor that you want it removed .If she didnt accept you can sue her. |

You have the legal right to cut branches, roots & vines on your side of the line. You do not have the right to bill your neighbor for doing so.
** Note: The above is not legal advice, but a discussion of the legal issues presented by your question. Local laws or your situation may vary the general rules. For a definitive answer to your question you should consult local legal counsel.** |

no it is not their responsibility. however, you can cut it back to the property line yourself. get over it and buy a hedge trimmer. |

You could offer to pay half. Generally neighbors split fence costs. This vine problem is a different issue, but it would make it easier for you to have the work done and have the 1/2 bill sent directly to the neighbor. You absolutely should talk to her about it or send a nice letter. At some point there will come a time when you will be glad you handled it this way. Next time it could be "your" tree that falls on "her" car, or whatever. It pays to go the extra mile with a neighbor. Also, are you an owner, and is she an owner or a tenant? If not, then you or the property owner should deal with the owner. Being friendly and nice in these situations always is helpful. If you can't get cooperation, then you could take care of it and sue for costs, since it was caused by the neighbor's plant and could continue to be a problem, but this will lead to a huge problem with your relations with your neighbor even though it is "right." |

You can remove them or pay to have someone remove them and send her the bill. Warn her first in writing. |

The first step is to try to be civilized. Talk to your neighbor, make sure she's aware of the problem her plant is causing on your property. Most people are willing to be good neighbors. But if that doesn't work then get a lawyer. |

don't be an ***. just remove it yourself and then ask her to kill the plant . if she refuses you can call the board of health and lodge a complaint....make sure you take pictures first. |
