Issue a demand - sent a certified letter, use the word "demand" for payment, set a date by which they must pay you. After that date passes, file a claim in small claims court. Get a court date, take them to court. Be prepared - bring all your documentation, including rental agreement, statements, and letters. The judge should find in your favor, and you'll get a judgement.
Then comes the fun part: collecting. The court will not collect for you. Depending on your jurisdiction, you might be able to attach wages or have a marshall collect from a till if they own their place of business. But most likely, you'll have to hire a collection agency to track them down and collect for you.
A collection agency will probably charge you 30-50% - this may seem high, but it's better than not collecting at all. Chalk it up to the cost of doing business. Definitely be very careful about screening the next tenant you rent to. Every landlord has to go through this at some point - many are just happy that there's not significant damage to the property. Sue them in small claims court, just make sure you did everything legally. Have everything documented, just prove your case in court and you will be fine.
needless to say I just won over $20,000 in a judgement against my former landlord, she evicted me illegally.

next step is the judgment, once you have the judgment then comes the hard part collections, you can try to pawn of the judgment to a collection agency but unless you plan on doing much business with an agency they will give you very little on the dollar maybe 30 cents maybe 20 cents on the dollar
or you can try collection by yourself, do they have any assets, steady job, know where they are moving too? |

thats good but ya will have to take legal action against them and remember that the landlord tenate laws vary from state to state, and so do your and thiers rights aswell so just keep that in mind and be careful!! |

You have two choices, get a judgement against them and then try to collect by many different methods, like towing their car to auction it off or even selling your judgement to collection agencies. You can also elect to surrender the judgement and have the IRS 1099 them. At least you have the satisfaction that they cannot run away from the IRS.

Sue them or collection agency. Be aware neither may work. Be sure to consult a lawyer, any attempts at collection will have limits in local or federal law. If they do not have much in the way of assets them suing them may not help much, but you should do it anyway. |

Well, court. However, doesn't mean you'll get a ?!@# thing! I've been through this process 3 times over the last 5 years and have yet to receive any funds from any judgement that I won. The only thing that happened was it cost me to file the complaint in addition to the money lost in rent and damages. They will have the judgement on their credit report if that makes you feel better... you may get lucky and they will pay but if they didn't pay then I'd bet they won't pay now.
I read some of the other comments and yes it is up to you to collect (if you can ). In one case that we won through the court, we filed a garnishment on his check. Well, he was a captain on a BARGE, we couldn't garnish his check due to a martime statement he filed. Stupid me, isn't this for people in the military. Needless to say we couldn't do a thing!
Here I go again, but one of the most effective was that I have found in getting rid of a bad tenant offer them a couple hundred dollars to move out. Saves you the time of eviction and possibly some damage to your property. |

You need to send them to a collection agency or take them to small claims court. Be sure you have proper documentation of the damages done. Hopefully you did a move-in inspection, and now you need to do an official move-out inspection including photos and a list of charges for the repairs/replacements you will have to do. |
