Moosehound | No heat or hot water for a week in rented - What are my options? |
Hi all,
We moved into our rented 4 bed detached 2 weeks ago. On moving in I made mention that the heating system was not in a good state - all though it had recently passed it's service checks.
basically a week ago the hot water and heating stopped working. A plumber was sent by the land lord / agency and he said it needs a part. No it should have arrived and been fitted by Friday last week, then it was Saturday, then today (monday. But no part or plumber has appeared.
The house is freezing cold and and the kids are getting ill due to this. The agents have supplied a few small oil filled heaters but they barely make a dent. Then 2 gas fires arrived which work much better but don;t actually shut off properly or the flames leap from them so we have stopped using them due to safety.
I am getting nowhere fast and wll the while it's getting bloomin cold. Any suggestions as to our next course of action? Do we have any means of redress or are we stuck ?

It's a little known fact that local councils also have some clout in the private rented sector. If you phone up your local housing department - ask for the private rented sector team - they can liaise with your landlord to get the problem fixed as soon as possible and have legal powers if your landlord gets difficult.
However, they will not insist that your landlord takes any action other than what they would be expected to do in their own home. So if the plumber is being a bit useless, and it's not really the landlord's fault, they will be given a bit of leeway to get the problem sorted.
On a personal note, I'm really sorry for you - I lived in a private rented flat where the heating and hot water packed up, the landlord denied all knowledge and we were left to have freezing cold showers and sit in hundreds of jumpers until finally someone told me the local council will intervene on your behalf! sorry for your poor kiddies too. |

Try to get the number of the plumber and pressure him directly, or keep on at the landlord/agent to keep ringing up the plumber. It really sounds like its a problem with a lazy plumber not getting the part, rather than the landlord or agent, as you've said they've provided alternative heating. Tell the landlord/agent that you are thinking about either calling your own plumber or moving into hotel accommodation and will send them the bill for it - that should get them to ring up the plumber again and make sure this is fixed asap!!! |

You need to put this in writing to your landlord AND your agency.
Unfortunately there is not that much you can do, especially as they have provided you with heat (no matter how ineffective they are). You may be able to request a rent reduction seeing as you have been without heat for so long.
My advice would be to go down to your local CAB and see what they can advise. I wouldnt be too hopeful though! A few years back I lived in a basement flat which was flooded with sewage. Half the flat stunk to high heaven. On top of that we had major electrical problems and found that the lights were illegally wired into the sockets, And our boiler stopped working. We got someone out off our own backs because we were so fed up with being cold and he condemned our boiler because it was unsafe in 7 different ways. We got NOTHING out of this. We went to the CAB and all they could advise was that we go to Environmental Health who would condemn the property and therefore make us homeless - not practical when you have animals. So we lived with it until we could finally afford to move out... 6 months later.
If you are lucky enough to be with a large rental agency then you could threaten to go to the papers and local media unless they address your issues.They will not want bad publicity!

Hi,that's a disgrace.Think your best bet will be to go to citizens advice.Theres one snag the landlord may get stroppy.Try contacting him again & tell him you need heating for the children esoecially has the weather as become extremely cold.Good Luck |

I would write to the agent or landlord, keep a copy, say that unless the problem is fixed within 24 hours, you will arrange for someone to fix it and send them the bill, or pay for it yourself and deduct the amount from next months rent.
Quote health & safety regs, especially regarding the replacement fire they sent.

dont on any circumstances use those fires please dont, get in touch with your landlord now right now, you have no hot water, no heating adequate to heat yourselves ring that landlord up, get in touch with a gas fitter, to get the corgi number, to ask about gas regs and if its legal to be left without heating and water, hot water is essential, if you have children and if they are ill, but that landlord wants informing nag nag him to death |

Heat and hot water are considered necessities when renting unlike A/C which is considered a luxury item and rent can not be held back for lack of working A/C. You do have legal cause and have a legal right to hold back on the rent |

Tell the landlord that unless he provides decent heating and hot water, you will move your family to a hotel and charge the expense to him. Tell him its against the law to not provide you with adequate warmth or hot water. |

Hi I live rented acomadation and iv. Had problems with the heating ever since I moved it she has a back boiler and its costing 80pounds aweek I just can't efford it I am on benfits with to young children and they have both been ill where its so cold there isint even any insulation she has promised for moths to get some one to come and look but has done nothing and on wesnday I put the heating on and hot water came through my 3year. Old sons room its lucky him or my 9mth old daughter wasn't in there at the time because they would have been seriously hurt it is now fday the plumber came out all he done was stop the water some1 eles is due out tomorow to hopfuly fix it but iv had to stay. With my mum as no hot water and heating can I hold back any rent and is she liable for my son mattresse witch is totally ruined I can not efford to replace this
