That aside... You gave first/last months rent or first months rent plus a deposit? Exactly how was it termed in the agreement? In your question you term it "two month's rent" and in your additional details you call it a "deposit." Make up your mind.
A deposit cannot be used for the last months rent unless the landlord agrees. The landlord may consider it a deposit, returnable only after you move out. In any case, you must give 30 days notice before you move. |

You have to give a 30 day notice of vacating or the landlord can hold you responsible for that month. Meaning she can charge you for that month. Because the law looks at it like she is losing out on that month. In the 30 day notice she could of posted her ad for a unit for rent and found a potential renter in one month time. Now she is out that month supposedly.
So since you did not give her 30 day notice she is keeping your last months rent and charging you for the next month also. It is legal.
Hopefully she will give your deposit back. |

All states require you give more that a weeks notice. Usually it's 30 days. Failure to do so will result in you being responsible for the following months rent. Your security deposit is not rent...nor can it be legally considered rent. |

Well there was no lease signed...nothing signed, so I don't see why you just can't leave.
She pressured you into agreeing about her boyfriend moving in and you obviously aren't happy with him living there. Since she pressured you, and when you first moved in you gave her 2 months worth of rent money....I'd say explain all of this back to her and just go.
Yeah, most people do give a 30 day notice when they move out but if you aren't happy you aren't happy. There is nothing signed on paper, you can leave next week |

General the law requires a 30 day notice but if she sued I would argue that the boyfriend made the place unbearable and this was in effect a constructive eviction. I wouldn't give her anymore. I would ask for my money back since she already has a roommate to take up your part of the rent. |

If I am understanding you correctly, you paid for first and last month's rent before moving in. If you have already paid for this month (and haven't gotten behind previously) and are moving out before the end of the month, then no you do not have to pay for another month. You are effectively giving her one month and one week's notice. 30 days is all you are required to give. |

A 30 day notice that your leaving would have been nice. I doubt you will get the month deposit you gave her, so i would not pay the next month. The drama and arguments without a lease could be fun, but really upon moving an additional person into the apartment, may affect your decision not to stay, further the lease must be in her name, and she is subletting to you, so she would have to give you 30 days to vacate, and the fairness is that you give her 30 days notice. |

What kind of land lord is this?lol Anyways she may not be able to collect anythin, because there is nothing in writing. She will keep the deposit, that's about all she can do. :D |

You gave a security deposit? If that is the case, then don't pay next months rent. Just tell her to take the deposit. You really have to give 30 days notice on a month to month lease. |

You paid her in cash and received no receipt? You are screwed. It's a life lesson you paid in advance for.
You paid her with a check and she cashed it. You might have some money coming back to you, if the dates line up reasonably.
You paid her cash, have a receipt? Move out before 2/1/2009 and she's not legally going to be able to keep the money. Your receipt will prove that.
You wrote a check, the dates line up reasonably, she won't return the one month's amount? Say hello to small claims court to get your money back after paying the fees to go to court. 50/50 on winning. |
