Non-refundable pet deposit?
I have 2 dogs and i had to pay a $250 non-refundable pet fee for each dog. I have recently moved out of that house because of water problems and mold problems the landlord refused to fix. I also paid a $600 security deposit. She charged me $341 out of my security deposit for replacing the carpet pads for a "urine smell". Shouldn't that money have came out of the pet deposits that I paid??

Yes it should have. You have a great case for small claims court.

Start of first with a letter stating that you think this is wrong, include copies of your original lease agreement which outlined what deposits went towards what. "urine smell" is heresay, argue that in court.

Tell her you';ll be contacting an attorney.

You said you had to pay a "pet fee", not a "pet deposit". These are two totally different things. Pet fee's are not used for damages and are paid solely for the privilege of landlord allowing you to have a pet, while a pet deposit is used for damages incurred by your pet. Read your lease.

I'm not sure if it should have or not, but at any rate, I believe you should have received ALL of your money back, because by refusing to fix the problems, that is called "constructive eviction", which means the landlord broke the contract... That makes the whole thing void, including the non-refundable deposit... I'm pretty sure that if you go to small claims court, you would win... I'm NOT an attorney, but I do watch a heck of a lot of the small claims shows on TV, and have seen that very thing MANY times... that's what all the judges decide when the landlord won't fix things that are vital, like a mold problem... That is possibly life threatening... however, you have to prove it... I hope you took pictures or kept records of the problems, otherwise, you may just have to take your lumps and move on... we had almost the same thing happen to us, and had no proof of the problems... So what could we do? we had to eat a $200 pet deposit (non-refundable) for ONE LITTLE CAT, who did nothing, plus they took out another $237 for painting (ridiculous) and carpet cleaning (which I did before we left)... had to eat the loss, because the only thing I could prove was the carpet cleaning I had done, so I could've gotten the $75 they charged us for that, but no pictures of the mold (black mold, had to move) so no constructive eviction.... If you have proof, stick it to 'em....

yes it ABSOLUTELY should have. It sounds like your being ripped off and if I were you i'd sit down and have myself a free consultation with a lawyer.

sounds like the landlord is milking you, it may even have been illegal to charge the pet deposit, in many states you may only charge a certain amount for deposit this includes security deposits and pet deposits are combined

go down to your local court house get the form for small claim fill it out, and file it will be worth it

lol yes thats what it is for..they make u pay a pet deposit incase of something needing to be replaced or fixed..id take them to court..they are stealing your money

Yes I think so. I think you are being taken for a ride by slum lords. They refused to fix things and basically forced you to leave unlivable conditions now are charging you for something you already covered. I'd see a lawyer!

Unfortunately, it SHOULD but thats not how most places work...Sounds like a typical scumlord, but ultimately you are in a contract and responsible for any damage,and taking her to court will be costly...I wish I had better news for you, but I think its a "suck it up and learn from it" kind of experience...Good luck with the new place, I hope you have a better landlord. (I had to move due to mold and water from a place that the landlord wouldn't fix...Its worth the money to get you and your pets out of there..Mold can kill you and your pets can die even faster....)

The pet deposit is there to take care of any damage done from the pets. You paid $500 to have your pets with you. The carpet small damage should have come from that. But there is a detailed list of damages like nail holes, screen, doors, windows, woodwork, plumbing, electrical...that is to be paid with the damage deposit money..and the balance returned.

My renters like me call the handyman asap when the toilet they stopped up has to be fixed or the sink they clogged has to be unstopped or the $225. storm door their kid destroyed needs to be replaced, etc...they don't realize all these go against the damage/security deposit.

If the landlord has to fix anything he will probably charge 2 x as much as you could have done it yourself. So do small things yourselves and do regular checks to make sure nothing gets too far gone like a leaky roof.
