ask the landlord to change the locks and tell him/her the situation. Also call the sheriff's department for help. I did that in Mississippi while I was in college. The deputy allowed me to take their stuff to the road and leave it. They never came back.

First, U need to go to landlord/tenant court to seek the information or help desk. There, they will tell you the appropriate forms for you to get notarized. Then, you return the forms and in return, they will give you a court date. By law, if your roommates do not show up on the given date without rescheduling, their rights as a renter gets automatically waived. If they show up, explain to the court officials and show proof of the situation. They will give them 6 months to move out unless they file for an extension. If they file for such extension, they will need to show proof of their claim. Either way, if they are not out by the date given by the court, you are then allowed to get a martial to move out their belongings. By law, you are not allowed to touch their personal items following an eviction.

Check with your area's co-tenant process at the court house. If their names are on nothing it would be the same as a landlord 30 days written notice, if you want to be nice. If you get hold of them you can also just tell them to get out with their belongings. Written is better and maybe have them served with papers to come and clear out their stuff or it will be forfeited because of unpaid bills.

if their name isnt on the lease then you can just kick them out they have no legal right to my knowledge. If you want to cover your *** give them a 30 day written notice and have them sign it. make a copy for them and keep the original. I would just give them the boot

As long as the lease is in your name and not theirs you can have them barred from entering the property. But, under no circumstances can you sell or destroy their property. you can, however, hold their property until you have received payment for back rent and utilities. hope this helps.

If the lease isn't in their name, and you don't have a sub-let contract with them, I'd try to contact a family member or friend to let them know that they've been tossed out. DON'T put their stuff to the curb, because they could hold you responsible for it. Ask the family/friend to come and get it. Consider changing your locks and move on. (Find more financially responsible roommates)......Good luck!

Call your local law enforcement - sheriff dept. are usually the guys to help. - They can point you in the right direction. You could just change the locks and put their stuff out - not very nice but it would get the job done.

If everything is in your name, and you don't have any kind of written contract that he/she will pay a percentage of the bills, you are screwed.. Sorry!

most states or countys have a self help application services that can get you pointed in the right direction call or visit your local courthouse they usually cant offer you advice or even tell you the forms to get but like in my case they told me about the self help place im in california and they helped me through my divorse and settelment as well as coustody of the kids

EVERYTHING IS IN YOUR NAME SO YOU CAN TELL THEM TO LEAVE WHENEVER YOU WANT. IF THEY'RE NOT ON THE LEASE THEN LEGALLY THEY AREN'T SEEN AS TENANTS ANYWAY. WHEN THEY COME BACK TELL THEM TO GET THEIR STUFF AND GET OUT OR GIVE SOME MONEY BEFORE THEY ARE ALLOWED TO STAY IN YOUR HOUSE.

the only way you can do that is if you have a written contract and they violated their lease with you. Go you your landlord and tell them what is happening and they will help you to get some letters to get rid of them out of your place and send them certified.You could go to legal aid and have them help you on your states statutes when it comes to rental agreements and the steps you can take. Cops cant do nothing since no crime was committed.If they breached their time with you, you might be able to keep their deposit if you took one from them. That is what I did since the same thing happened to me.

Unfortunately, you cannot evict your roommates. Your landlord has to do that.

First thing is to check if you have a legal or written agreement on this sub-tenancy. If their belongings are still there, you could hold it as a surety until they return. Also, you should try contacting your roommates to see if they are alright and come to an agreement with them on the next step.

As it sounds like you are collecting weekly payments (uncommon), and you think they are not coming back or not going to pay you when they do, why not give them a notice of termination as stated in your sub-tenancy agreement. If you don't, then a one-month notice in the case of monthly payments or 1-2 weeks notice in the case of weekly payments could be a yardstick. Finally, it would be helpful financially, if you have new subtenants in-waiting before you 'evict' your roommates.

All previous advice is well intentioned, however, every state is different...find free legal assistance from the Office of Legal Defense. Whatever you do, don't put their stuff out on the curb without due process...you could be liable for it later.

Ok, So i know what can be done if the other person is NOT on the lease. What if my roommate IS on the lease? What can i do when it comes to the 30 day notice of ME leaving, and because my room mate doesn't qualify to stay, my room mate could potentially stay and i would be just as liable for any damages my room mate does, however, i'm the one looking to leave. Do i have the right to put a Court Order on my room mate for my room mate to leave before the 30 day notice I PUT IN is up, or do i have to wait until after the 30 day notice IF my room mate decided not to leave out. I am in Tennessee.
