So, I'm in my apartment tonight, relaxing and grateful that I had the evening to myself. All of a sudden I see a 4 foot long snake in my bedroom. I guess it was someone's pet that escaped. I completely flipped the eff out. I'm still trembling. Luckily, a neighbor was able to remove it.
Even though, it's gone I'm still a wreck. I want to know....can I legally break my lease? I called my super and he was no help at all (he made some ignorant comments, including quote "Somebody put that sh!t under your door."). I plan to call the landlord tomorrow. But I really want to move now...can I? |

I empathize with you, but I doubt a court would recognize that situation as a breach of contract on the part of your landlord and allow you to break the lease. If you had some examples of action or inaction that demonstrated negligence on the landlord's part then maybe, but landlords don't routinely check for snakes...this was a fluke occurrence. |

Check the terms of your lease. If it says you can be assured of a snake free apartment then the landlord vioded the lease. If snakes aren't mentioned then you are stuck there.
Actually, all the super is required to do is maintain the place as livable.
You can't break your lease without penalty yet. |

No, you can't. The snake is gone now. Would you break your lease if you saw a mouse in your bedroom, or some bugs? This is life; things like this happen sometimes. I saw a snake in my backyard last month, and I still live here in my house. If you do break your lease, your landlord can sue you for all the remaining rent on the lease (and he/she can get it from you, too.) |

Nope...not unless you can prove that the landlord was negligent in some way by allowing the snake to escape.
You don't get to break a lease because you have bad nerves.
If you are that paranoid where you are staying, then the issue is you and not the building. |

Hopefully, this was a one time occurence. I wouldn't go through the troubles of breaking a lease over it. My first suggestion is to ask the landlord to inspect for areas that can be sealed off and prevent snakes from entering the apartment again.
If you calm down, and still feel that you need to vacate, approach the landlord in a calm manner about it. If he feels that you are attacking him personally about this situation, he will be less likely to help you.
This is not grounds to break a lease, unless his lease specifically does not allow reptiles or pets in general. Even then, you would need to allow him time to get the resident to remove the snake from the building.
He may offer you a lease buyout option, but it will be expensive. He may also allow you out of the lease when one of you find a qualified renter to move in. |

In most cases, the only time you can legally break the lease without paying a ton of money is if the other party breaks it first. This means your landlord has gone against his end of the deal. Depending on the fine print of your lease, this could include their failure to maintain the apartment, like a fridge not working, clogged plumbing, etc. Even then, you pretty much have to have something proving that you tried to get the issue resolved. So, snakes probably are probably not going to get you out! |
