Scammed | Ohio Real Estate Disclosure Law? |
We purchased a home & on the 2nd day of moving in, we found a major crack in the slab floor, under new padding & carpet. Which made us look closer & discovered the crack goes fro one end of the house, to the other, & minor crack going
through the kitchen. The Realtor, said that as long as it was fixed,(Which is sadly done by the guy's that laid the carpet), that they didn't have to disclose it.
The house was sold at auction, remodeled, & sold to us. The Realtor was acting as a double agent on the deal. What is the law on this, & Will Someone Please Help Us Figure This One Out??? |

First, have a contractor look at the cracks. Stress cracks are a normal occurrence and unless there is settleling, it shouldn't be a problem. You state the cracks were repaired. Were they and perhaps you're not satisfied with the quality of repair? If there was a good faith effort on the part of the seller to repair them, then I don't think you have a case against the Realtor.

The Realtor is correct. Since the defect was repaired, the defect no longer exists and need not be disclosed. However, if YOU found the crack in two days, why did your home inspection service not find same ? Or did you naively avoid a home inspection to save a few hundred bucks ? |

In order to have a cause of action against any party, You as the plaintiff have the legal burden to show to the court that the party Knew the fixed was not a fixed but an intentional affirmative action to hide the material defect from you the buyer |
