Ok...Hopefully,last question...?
They said we got the house,but they are meeting tomorrow to sign papers. Why aren't I included? Even if I am not a co-signer,I am his (buyer's) wife, so when my name goes on the title,when does that happen? Could anything else prevent us from getting the house now?

No,the co-signer (I think) and my hubby signed papers. I don't work so they didn't
use my credit,which is not good anyway. I don't know what kind of papers they signed,& how do I find out if the property had a title search & the results?

When you walk out of closing with deed in your name,, that's when you know for sure.
If you worry and worry and worry,, it won't make anything better,, won't make anything happen faster,, won't help at all. will make you old before your time,, cause you to be irritable,, etc.

two words "community property", it's his credit on the line but in every way your property as well as his. The only exception to that would be if he purchased an investment property on his own and excluded you deliberatly. You will however have to sign the deed and deed of trust i believe. But all the other junk should state that there is a spouse who is not listed and the rest is all credit related. Don't worry.

Actually, you should be included. The signing is where the names are listed that goes on the title, and if you are on the title, but not the loan there is a form you have to sign to the bank stating that if the house gets foreclosed on, you can not dispute it. Which makes me wonder if someone is feeding you a line of bull.

You can have your husband's name on the mortgage but the DEED TO THE PROPERTY can be listed in BOTH names. I have seen people make this mistake so many times, don't do that. If the papers are signed then you have to apply to your lawyer to have your name added to the deed. And yes, you should of been at the closing. If approved and the title is cleared, and your mortgage company or bank set up the closing, then the only thing to worry about is if there are any other fees that you would have to pay. Your argument really is with your husband to get your name on the deed. If he declines and the credit was obtained in his name he does have the right to refuse listing the home in both names.
Usually keeping property or money in one name only assures that if there is a disillusion of the marriage, these assets will revert to him. You may have to face this situation, so get your name on the deed.

Ok, yes, they qualified you guys on your husbands credit alone. You will need to put on title, and the Quit Claim the property to him. Quit Claim deeds transfer or "quit" any interest in real property. The grantor may not be in title at all, so the grantee cannot assume that the grantor has any real interest to convey. However, if the grantor were, say, married to the owner of the property, signing and recording a quitclaim deed in favor of the spouse would transfer any interest the grantor may have in the property to the spouse.

If your credit isn't good and the borrower's credit was, then they were able to secure the better loan available. Wife's don't have to be liable for the debt, which is good, especially when they have no income. But, your husband and his co-signer, (parent, I assume), can quick claim you one half of the title. Title is ownership, debt is a liability. In this manner you will own half the property, subject to the debt, but not liable for the debt in the event the loan goes bad or your husband and his cosigner don't pay the mortgage. In the event of a divorce you will own half the house which is what a non working spouse is usually entitled to and if you can't pay the debt, then you sale the house or deed it back to you ex and his cosigner, and move own. You, of course would get half of the equity in that event and if there is no equity, you simply walk away. Anyone that doesn't work, that is married, has the best when given half the title without the debt. When they closed they signed a note, security deed, Hud one, (closing statement), disclosures, and various other forms that are standard in the mortgage industry, but can vary from state to state. Ask him for the HUD one statement and it will break down all the costs associated with the closing and he also got a warranty deed which conveys the title.The quick claim deed is like a warranty deed in that it conveys from the grantor to the grantee a certain portion of the ownership, (title). As I said earlier the ownership is still subject to the debt and if the debt is not paid then all owners, either via the warranty deed and/or quick claim deed will lose the property. Once the closing takes place as it seems that it has the deal is done and the house is yours and the other borrowers, once you get your quick claim deed or deeds.

It sounds like the financing was approved on the strength of your husband's credit alone. If your income was not used in part to secure the financing, more than likely your name will not be on the title.

This should not present much of a problem unless or until a divorce happens. That is where the community property laws will apply.

My husband and I own our home and although HE is the only name on the loan, I am on the tittle and DID have to sign some papers! He had more to sign then I did, but I did have to be present and sign some. If you're not on the loan OR the tittle, then you probably wouldn't have anything to sign.

You go on title when you get quick claimed on and it varys in price to quick claim someone. I don't think anything else coukd stop you from getting the loan.
