You can sue, but the burden of proof will be on you to prove that the owner knew there was damage under the tile and failed to disclose it to you. |

Unless you had a professional inspection which missed these faults, or you can prove that the owner knew of them and failed to disclose them prior to purchase, you are pretty much on your own.
If you decide to pursue legal action, be fully aware that a judge or jury will question why YOU didn't see these faults when you purchased the house. If YOU didn't see them, it's pretty obvious that the former owner may not have known about them either.
You are definitely fighting an uphill battle here. Do not expect to prevail. |

You should always have a Home Inspection (upfront cost)done before you sign the Purchase Contract that way you have some legal recourse if something does happen right after closing.
There is no "Years" to sue a previous owner because you signed a legal document that the owner disclosed everything he knew about the property.
You have no legal recourse at all. |

It is normally the reponsibility of the buyer to pay for a full structural survey to find faults like this before buying a property. You will probably not have much luck. |

You've got a tough case because to go after the owner you'll have to show that he knew about the water entering over time OR should have. OR that he was aware of the damage. OR that he did something negligent (like altered the lay of his land so it flooded). Not sure what the source of water is. In other words, this is VERY iffy.
My advice is to contact your county bar association and ask for a referral to a real estate attorney. Probably going to get 30 minutes for around $50 which will NOT resolve the issue but will give you options and advice from someone who should know his business.
Bring your real estate contract, ESPECIALLY any disclosure section. Did you have a home inspection before buying? Hopefully yes. Why was the defect not known then? If not, that's bad for you, but not necessarily the end.
How do you know about the damage now? (Like remodeling uncovered it?)
How was it determined that water had done it (such as a leaky pipe was discovered?).
What is the professional estimate of damages?
You said basement--was there a sump pump? Why or why not?
In other words, go PREPARED and having read your materials so you can answer questions the attorney will have and ask intelligent questions of him. Note also WHEN you discovered the defect--that will be important as well.
Did you have a buyer's agent? I'd ring them up and discuss as well but would absolutely consult with the attorney no matter what.
Oh and did you get a CLUE report for the house?

Did you get a Home Inspection before you bought it? A Home Warranty? If you didn't you are stupid! Why would you buy a home without any kind of inspection? If you did get an inspection you would sue the inspector against their E&O Insurance. |

you said it is old house - second never carry any warranty unless is agreed under the contract. It is your responsibility to inspect and accept before you buy a old house.

The previous answers are correct about the home inspection and also about you having to prove that the old owner knew of the problems. You can't sue him/her if they didn't know of the problems....after all, how can they possibly disclose something they didn't know?
The first one, rotten floor under ceramic tile, will be extremely difficult to prove. No one would lay ceramic tile over a rotten floor because they don't know if the rotten floor will hold the weight of the tile and grout.
As for the floor under the carpet, was the carpet new? If it was you might have a case. If the carpet was there for a few years it will be hard to prove. How often does someone pull up carpet to check on the floor underneath?
The fact that it took you a year to find the problems means that it is possible that the old owners didn't know about it.
If you did have a home inspection, you should have a case that the inspector should have found it. He would be the one to go after in this case. |
