Our landlord called us to go in and sign another lease cause they made a mistake on the rent do we have to?

Here's the thing, America is heading into a recession and your landlord wants to stick $75 on the rent. Sounds like you are expected to tighten your belt so they don't have to tighten theirs.

You legally do not have to accept another agreement and you are both tied to the current contract. I'd say, "look we aren't going to pay the increased rent, it is outside our budget, but if you are willing to shorten the current lease we will look for other accommodation starting today."

You are a guaranteed income, if the market keeps shrinking a mortgage will be cheaper than rent. It will be easier for you to relocate than the landlord to find a new tenant, but if you aren't going to pay the increase life could become uncomfortable at that address.

Your call, but I would be moving.

Wow... are you saying the landlord wants to increase your rent via a new lease????

That sounds incredibly fishy...and NO you do not have to sign a new lease....just honor the terms of the existing and know that he will probably be a jerk through out the term of your lease.

Didn't you all sit down together and go over the lease and then sign and date it?

Your question is somewhat confusing. You are saying the lease has the rent at less than what they told you? Did they ever tell you the higher rent and you agreed to it? Did you not notice that it was different on the lease, or did you notice and just not say anything? If at any point there was a verbal understanding with the higher rental rate, then the right thing to do is to re-sign the lease with the change, if you hope to be on friendly terms with the landlord. You could try to go to court over it but i'm not sure which way the judge would rule.

It SOUNDS like they made a mistake and would like to correct it. I seriously doubt that they do this as a matter of course.

What was the property advertised for? Is that what you're paying? If it is, I would tell them "no thanks" but be prepared for rent to go up (or possible eviction) at the end of the lease term.

If the property was advertised for more than what you're paying, it is possible that they screwed up and some poor dumb property manager is trying to keep from having to pay $75 a month out of his own pocket to an angry owner.

NOPE. The lease if fully signed is binding on all parties. What had you and they agreed to?
Do remember you have a year more of relationship with LL. If it was $75 against you, what would you expect LL to do? Suggest you negotiate a deal with them if you sign new lease, get something you want, first month at lower rate, first month at half rent, something you and LL can agree upon.

Do you have a copy of the lease you signed? If you do then no you do not need to sign a new lease they are out 75 a month till you renew your lease or move out.

I am not a lawyer but what good is a lease if it can be rewritten when the landlord asks for it? It then, it seems to me, is not a lease but a rental agreement. Did you sign it in good faith? did you know they made a mistake? It will be interesting to hear the other answers.

There is no way you are legally obligated to sign another rental lease after you just signed one. That lease is 100% legal until the day it ends listed on the contract. There is no legal way they can make you sign the contract and no judge is their right mind would award them any fees or allow them to pursue you in an eviction proceeding. It is their fault, not yours.

Of course you don't have to sign a new lease. What you have to do is to carefully decide whether or not you want to sign it. You have to consider the possible consequences. Will your landlord think that you are unreasonable and say goodbye to you at the earliest opportunity? Do you think it was a genuine error? Can you afford to pay the increase without a problem? You could compromise and offer to pay half of the $75. It may well be that the landlord is actually willing to accept the status quo, as it was not your error, so morally you should not have to suffer for it. If you were aware of the mistake before you signed, an honest person would sign the new lease.
Not an easy one. Only you can decide. But you can't be forced to sign.

You do not have to sign another agreement. You probably will not be offered another lease when that one expires though. Once you have a signed contractthey cannot MAKE you change the terms of the contract or evict you before the term expires as long as you pay your rent on time.
