Our rented property flooded due to a broken pipe. There has been damage to contents. Is the landlord liable?
Neither party has insurance.

The contents are ours.

It is an informal let.

He tried to fix the pipe earlier in the day, and clearly didn't do it correctly. Would this have an influence?

Nothing will influence the fact that the landlord is not responsible for your belongings. That is the reason renters insurance exists, because you are responsible for your own things. You opted to not have insurance, that was your choice, but now there is no one to pay but you.

He is in the same boat, he has to pay for the damage to his property.

No,your landlord is only liable for the building,you have to have contents insurance your self.He can't insure contents of a building that don't belong to him.

If he had been negligent then maybe you could claim against him,but if it was an accident,you don't have much chance.

If you rented a council flat,the council would not insure the contents,the same applies I'm afraid.

Much depends on the facts in the case. If he knew or should have known the pipe was bad and was about to fail, the landlord would be liable. If the pipe was inside a wall or floor and could not be seen and inspected, he would not be liable.

You are Only responcible for it. Landlord is given his property to you to for your use, and it is your responcible to hand over in safe or the condition when he hadover to you. U may question , while he handover the condition is bad? May be But u have agreed for the same condition and tken for your usage. So you are responcible for it and damages of your belongs.
The land lord may file a case if his propery is damaged, while it is in your custody. Make sure before you proceed....

Your both responsible..........landlord should have comprehensive letting insurance, or at the least building insurance. You should have tenants contents insurance. As you have not got insurance you are liable for any damage.
Lets hope you both learn.

therefore if neither of you had/have insurance - you're both on your own for replacement costs
