There is nothing that would cause an eviction to take longer then 2 months. Bankrupcy has no effect at all, rent is NOT credit and is not covered. |

make sure you get listed as one of the creditors on the bankruptcy and add late fees, etc to the rent she owes |

You need a BK lawyer, to go into the federal court and seek relief, but your eviction is stayed based upon BK federal jurisdiction over all matters at this point |

60K in rent arrears? It sounds like YOU have been dragging your feet, too. That sounds like you were being a 'nice guy' form the first time they were late.
People seldom go from star citizens to deadbeats overnight. It would seem there were early signs you ignored.
Have you carefully checked your insurance policy to see if this is covered? Contact an agressive lawyer. |

Im not sure how her bankruptcy is keeping her in your house...she is behind on rent and you should be able to evict her so that you can get a new tenant.
First things though, contact your mortgage company and try to work with them to avoid the house going into foreclosure. See if they would consider a short sale and list the property for sale and see if you can find a company that saves houses from foreclosure that can get you out of the mess.

It occurs to me that you could sell the property to your spouse/child/brother for $1, provided you have a contract to buy it back for $1.50 within a specified period ... say 1 month.
This way, since the property is now officially sold, you may have the right to evict more quickly.
This is a sufficiently serious matter on which you should get legal advice. |

Contact your bank or whomever is your lender and tell them your situation. You may be able to defer up to three months and the bank will work with you. They will review your statement and will really try to work with you because they do not want the home to go into foreclosure because it will cost them money. It is against the law to evict them yourself. Search web-sits where you can read upon landlord laws and educate yourself. |

If you couldn't afford to make the payment, then you shouldn't have bought the house! You had to KNOW times like this were going to happen and should have had enough money to get by put aside! To bad you chose to gamble instead of making sure you protected yourself! Do whatever you have to do now. |

Get her name into the credit report for non payment of rent. |
