Our tenant has left the state and abandoned his lease?
But he has two male friends staying in the house who said they were supposed to pay the rent since our tenant left. We do not know these guys and they do not have a lease with us...AND as of today, the rent is 10 days overdue. We have no way to contact the original guy who signed the lease and the two guys who are in the house are now officially 'squatters' in my opinion. How do we reclaim our rental house quickly? Officially, landlords have to give a 30 day notice for eviction to a one year lease tenant, but since the only tenant who signed is gone, we want those other two guys out of there now.

Note: The two guys were supposedly just 'visiting friends' when they arrived last month. Then the original tenant apparently left and the visiting friends stayed on. We only found out they were still there when we went to see why our tenant wasn't answering the phone and hadn't paid rent for April. The two guys who were there said they didn't know where our tenant went, but they would have his rent to us by the 5th and meet with us to discuss transferring the lease. They never showed up, no phone call, no rent....but we drove by tonight and they are still in the house.

Hmm..you have to do this right. I would call your local HUD office.

call the police and find out your rights you mabye abelt o get rid of them since they aren't on lease and they could be jailed. its they have lots of guts being there right now. take care.

File for eviction. If the original tenant is not paying rent and is not residing in the residience you do have grounds for filing for evicition unless the tenant is on vacation and left you a notice. Sounds like something "fishy" is going on there. Protect yourself before it gets out of control. Rent is not the issue. It is the issue of who is supposed to be living there.

Call a lawyer, start eviction process, be prepared for damages, try to learn as much as possible about the two persons living in the house as for followup civil suits if required

You have to file for a court eviction. Even though they are not in a lease you can't just throw people out on the street. They still get 30 days. If they arent paying rent however you can get creative on your property.

For instance you can have the cable company remove their wires so they dont have television.

Nothing says you have to provide a hot water heater so turn it off.

Air conditioning is not required for tenants only heat is. Just unplug the thing.

Oh and you can go in and ask for money every day ( I suggest 4am) because they aren't paying so you don't have to give notice of entry.

If they are miserable they will probably vacate.

call the police, and with them there swear out a warrant for their arrest for theft of services, and trespassing. Let the lawyers straighten it out. I am sure your lease would read that the utilities has to be in their name, That will show that they are not really tenants but squatters. and I do believe that is not legal in any state. If the old tenant was there then he could give them permission, but since he is not, they have no leg to stand on. Also the real tenant could actually be dead or even worse murdered by the ones left behind. Tell the police you fear for your safety and the safety of the real tenant.

Play hardball with these jerks, don't let them have any rest. They will tear up your place, and if police refuse, ask for a supervisor to be called. They are there to protect you and your property...

Some money is better than no money, right?
1. Get an attorney to file for judgement on this unit. If he is a no show at court, I believe you can get possession back.
2. If these two random guys are willing to pay, why not have them fill out an application, run their credit, and upon approval of credit get their money and move them in offically. Either to a new unit or have them take over the current unit.

Is there a problem with letting the new guys sign a new lease? I would also ask for a deposit from each one.
