Baby Kay | Parent signing a lease for a minor? |
I'll be 17 in two months, I'm planning on getting my own apartment. These apartments go off income, and I make around 650$ a month. I'm willing to work more hours then I already am if needed.
So I have a couple questions.
- Could a parent sign a lease for me, in their name with the apartment complex knowing that my dad isn't going to be living there with me. Will they okay it? If I prove I'm financially stable.
- Can I apply for food stamps at 17 if I live on my own?
Also, my parents said I have to leave when I'm 17, or else I'd stay until my 18th birthday. I have a 3.8 in school, and I've never been in trouble with the law. Additional Details I understand it is going to be hard, and the rent is based on income. So regardless I would be able to pay rent. Unless, it goes off my dads income, instead of mine.
I know a couple of my friends who are minors, that are on foodstamps. They have a card in their name, so I wasn't sure. |

The best thing is jump in and start swimming OR work out renting from mom and dad
YES they can, co-sign! They will take the signer’s income into consideration.
YES you can get food stamps.
YES there are scores of paperwork for YOU to go though,
YES in most states your parents are still responsible for providing you shelter and food.
YES this is going to be awkward for your parents. As the rent subsidy board and the division of family services will want to know if you are still under your parent’s supervision, or what?
I wish like you I'm sure that you could stay at home another year.
I'm praying for you kid.

As a minor you can't enter into a lease contract. Your parents could sign the lease, but if the property is income limited their income would determine what the rent was and even if you could rent there. Since you are still a minor, your parents would be legally obligated for the lease payments, not you.
You are still a minor at 17 and your parents are still legally obligated for your support whether they like it or not. You won't be able to apply for food stamps either as it must be based upon your family income since you are still a minor.
If your parents are kicking you out at 17, you probably need to speak with the local child and family services office and possibly with an attorney as well. What they are doing is actually illegal.
Things will change when you turn 18. But trust me on this, $650 a month is nowhere near enough to survive on today. Not with anything resembling any kind of a life that you would want to live. It's not even minimum wage.
Addendum: I'm not trying to delve into your personal life or be judgmental. I'm trying to provide you with some practical advice based upon my understanding of the law. Since you are a minor, any income-restricted property will be based upon your total family income, both yours and your parents. Unless they are of very modest means their income could even be too high to qualify at all. They ARE legally obligated to support you and that means THEY pay 100% of the rent, utilities, food, medical care, etc. You may be able to force them to do this but you may need the assistance of either the DCF folks or an attorney to make that happen. |

Sounds like you should be applying for a dorm room in college or joining the navy and just leave your parents behind in the dust for a while. What kind of a relationship do you have anyway that they would want to be rid of you at 17?
Yes most places will accept a co-signer . It is actually in their best interest to do so since that means they are pretty much assured that the rent will be pd. if you should decide to ditch the apt. and move out early. My question is will you be anle to find a decent apt. that will rent to a 17 yr.old? |

If your parents sign a lease in a subsidized rental situation.. your lease rate will probably be based upon your parents' income.. Further If you do not pay, they will be forced to pay..so they may not be..
$650 a month is barely enough to buy food..
You probably should investigate roommates to share costs. |

You need to go to the courthouse and check to see the emancipation laws . In Pa a minor can be emancipated. Your parents sign a legal paper basically giving up their rights to you and saying you are an adult and on your own then you can legally sign your own things and if you go down to your local assistance office (the courthouse can direct you to this too), you should qualify for all kinds of help to get you started. |

The apartment complex would probably be more than happy if your parent signed the lease for you. This would make your parent responsible(legally) for the rent if you defaulted and/or any damages that would occur. So.. I'm sure they would be okay with it. The bigger question is whether you and/or your parent be okay with it(dont know the situation). The answer to your second question is yes, you would be eligible to apply for food stamps. They will make you show you are living on your own (emancipated) and would base the amount that you would be eligible for off of your income. Good luck and please, make sure you think out all of your decisions before you make them. It is always soo much easier getting into things than it is to get out of them if things dont work well. Maybe consider month to month lease somewhere??? |

Your parents can co-sign your lease and don't have to live there. Co-signing just means if you don't pay, your parents will. So, you need to make sure your parents are OK with it. I don't think you can apply for food stamps, because you are still a minor. You would have to prove that youj were completely independent of your parents before the govt would help you. It doesn't sound like you are financially able to move out - I would wait one more year and save up some money. It is VERY expensive and stressful living on your own, so you want to be as prepared as possible.
You should apply to college and move into a dorm. I think that would be much easier, you would get out of the house and you would be doing something for your future. |

Yes they can sign but then they are responsible for the rent, no you cannot get food stamps, and with only $650 a month you cannot support yourself please be realistic |

I'm not sure where you are but if your parents or dad is willing to sign a lease for you, you have to remember if you don't pay the rent they can go after your dad.
I'm sure you realized that, but sometimes adults have a hard time with teens who think they are mature enough and really aren't.
To me,you sound as if you have a plan, are responsible enough to have a job and realize that you may be able to do this for yourself.
You can apply for food stamps and are eligible.
I applaud you in your efforts. |

This could get complicated. Your parents must sign the lease unless you are granted you are your own legal guardian. This must be done thru the courts. Until you are 18, you cannot be held responsible for any contract you sign unless special steps have been taken.
Below is a link to FSN the dept responsible for food stamps. The is for a pretest to see if you may be eligible.

The situation seems odd. Why are your parents telling you to leave. There seems to be more here than meets the eye. If you have more q's you may email me.
Good luck. |

No. Legal contracts must be signed by adults 18 and over. Most apartment complexes will not sign a Lease Agreement with anyone under the age of 21. Even then most places require income and credit checks, and you haven't been an adult long enough to acquire either ... good or bad.
A Lease Agreement is a legally binding agreement between a landlord/owner and a person(s) residing in the property.
No. You cannot sign up for food stamps until you are 18. Until you are 18 you are still legally a dependent of someone. Once you are 18, you may be able to sign up for them, but that does not mean that you will qualify for them. Food stamps are issued not just on income level, but on need. Wanting to move out and on your own at 17 is not considered a need situation.
You may be able to get around this by becoming legally emancipated, but each state has its own requirements for obtaining this status and it costs money.
Most apartments that are sliding scale are reserved for families in need or other special needs populations. A single teenager would not likely qualify even if they did sign a lease agreement for the unit.
You may need to look into getting a room mate(s) which is what most young people do when they first start out. |

First of all, your parents can't legally make you leave until you are 18, social services would have something to say about them. As for your parents signing a lease for you, it depends on the landlord. Ask them when you call to inquire about the apartments. Some will and some won't. |

You couldn't sign the lease since you're not of legal age. Your parent would have to rent the unit and be subjected to the credit check. However, your occupation of the premises would likely be considered a sublet since neither of your parents would be occupying it. Check the lease to be sure subletting is allowed. |

are they EMMANCIPATING you? well i moved out when i was 15 (kinda my choice and kinda not) but i was not able to do much even though i was legally responsible for myself i couldnt get loans and such...now if you are pregnant or have a baby the government is likely to see you as an ADULT and not have to use your parents....ive been there and done it all!!!! i think i could answer some more of your questions about your expectations , if youd like you can email me at krstymixon@yahoo.com |

Most manager's, corporations, tenements, etc., are reluctant to rent to a child under the age of 18 as they have no recourse. A child under 18, unless emancipated (released by the court as a responsible individual) is not responsible. don't ask me why but that's the way the court looks at it. Also your parents can not "ask you to leave" until you are legally 18. They can contact child services and request you be removed due to an uncontrollable attitude, drug use or other problems which require more assistance than they can give. It will be up to the landlord's as to whether they will accept your Dad and yes, since he will be the lessor it will be based on his income. |
