You owe money up to the date of eviction. If you've received a notice but not gone to court, chances are you are not yet evicted. A landlord will give a notice of INTENT to begin proceedings, which they are required to do by law before eviction proceedings can begin. If you've paid the rent for the month chances are he will not bring it to court. If you've already been evicted and still owe the money, then you have to pay it. |

Depends. In the end, you will owe for every day you actually live in the place. You are BEING evicted, but you haven't actually been kicked out, have you? Then you still owe the rent. If you ARE kicked out, the day you walk out you will owe rent for every day you did live there, pro-rated, and not a cent for any day after. |

The bad news is you already were sued otherwise you wouldnt have gotten a conviction notice. The owner sounds very anal so if I were you I wouldnt pay but I would not spend the money as it sounds as if he/she will sue you in small claims court. |

BUT the landlord probably will not accept any rent at this point- accepting late rent would void the eviction process so they will not want to do that. They will evict you and obtain a judgment and then you will need to pay whatever the judge determines that you owe. |

Since every state and province is different, check your lease to make sure that you haven't paid a 'deposit' which will be returned to you when you have left and they find no damage to deduct from the amount that you have given them. In Canada they ask for 'first and last' and they return the amount after you leave or they sometimes apply it to your last month and you don't pay for last month. They actually owe you interest on the money you gave them. It is payable to you every year. Don't forget to get that from them. |

Check the lease. It will spell out the terms of the deal. Unless it is incomplete or has something that is illegal, the lease is the rule book you need to go by.

Even if you are being evicted, you owe your landlord rent money up until the day they finally kick you out. You are most likely going to be sued anyway unless you agree to pay him what you owe. You have no legal argument against paying rent so it is an automatic win for your landlord if he takes you to court. |

Most landlords will not take the time/money to sue you in small claims, if paying the rent would end the "eviction process" I would pay it, however if your being evicted either way, Id save the money for your new place. Plus if they are keeping any security deposit, they can use that. |

you might still be sued for breech of contract. if you were under a lease and did not complete the lease, nor pay the termination fee (usually 125-200% of rental rate), they can sue you.

If you want to stay, call the renter and ask them if you can pay up plus penalty and stay. But I wouldn't pay up if you are planning to leave unless you get a letter from them stating that you are flush. You will forfeit your deposit and it may damage your credit. |

In most tenant/landlord laws if you have signed a lease for 3,6,9 or12 months whichever, You are responsible for the rent for the length that you signed your lease for. If you have 6 months left on your lease you are responsible for the rent for the next 6 months or until the landlord re-lets your unit up to the expiration of you current lease. But if you pay 1 month in advance I don't understand why you are being evicted for nonpayment of rent. But to answer your ? yes you still have to pay even though you are being evicted for whatever reason. |
