Please help!! How can I stop from getting evicted from my apartment?
No sarcastic answers please, as this is a very situation that my family & I are dealing with right now. We just had eviction papers served & are supposed to be thrown out this Monday - just one week before Christmas. My husband got laid off from his job a while back & trying to make ends meet hasn't been very easy. We live paycheck to paycheck & have hardly no extra money. We have two children, our youngest is just a little baby. If we end up getting thrown into the street we literally have no where to go....I am so lost & scared....I have no idea what to do. Has anyone else been thru this or know of any state programs or anything that might help us? Or know of any way to buy us a little bit of time? We live in PA.
Any help would be greatly appreciated.

Uhh, Landlord, you must have missed the very 1st line - I SAID NO SARCASTIC ANSWERS PLEASE!!!! Do you really think that I WANT to be in this situation?? That we just stopped paying our rent on purpose?? This really wasn't the advice I was looking for. Save your useless answers for someone else.

When you say you have had papers served, do you mean the 5 day notice to writ or quit? Or are they an actual judgement from an eviction hearing? If it hasn't went to court yet, you have until then and probably only a few days after the judgement is against you. Use that time wisely. Call around like some other posters have mentioned, Salvation Army is one place to start. They might be able to help you with the back rent OR have a shelter for you. Do you have any family at all who you could stay with for a while? Friends? If you haven't had a court judgement yet you have a short time left but at least you won't be out on Monday. Not being mean, but get off the computer and call NOW.

Go to the Salvation Army Family Shelter. They will let your family stay there and help you get back on your feet.

If he was laid off then he should be eligible for Unemployment when he got laid off did you call your landlord and explain that you might be late? because of the situation? Communication is the key here. Next contact the salvation army they might be able to help. Have you contacted welfare, food stamps section 8 etc?

This is probably more advise that you "Don't want to hear", however, it is the truth.

If you cannot pay your rent, you should move out willingly and quickly.

An eviction through the courts is not going to help your situation in any way. Potential landlords will refuse to rent to you for many years if you have an eviction on your record.

The landlord is not running a charity. The landlord is running a business in which he gets paid by you to stay in his property. No pay - no stay.

Now, if you were only served the initial Notice to Pay or Quit, you can wait and force an eviction, rack up more debt since you can be held responsible for the court fees, attorney fees, rent owed, late fees, ruin your credit & rental history, etc....
OR
You can find the nearest shelter and save yourself and the landlord time, hardship and money.

If you were served the writ of eviction and the sheriff is coming to put you out on Monday, you really need to find a shelter ASAP because once it has reached that point there is no way to stop it ... unless all rent owed, court costs, legal and attorney fees are paid in full AND the landlord accepts the $$$.

Since you have not obtained another residence the marshall will direct you to the nearest shelter. There are no programs that will force the landlord to support your family any longer, the eviction came after he already supported you for longer then is decent.

Most of what you posted is immaterial and has nothing to do with your eviction or the law. WHY you stopped paying rent is also completely immaterial. If you cannot pay the rent, then you will be evicted. PERIOD. 3 days notice is legal in most states.

Have you gone to court yet? It sounds like you have just gotten the initial notice. They have to take you to court before they can physically remove you. If you are not out on Monday they have to wait to file with the court on Tuesday. They will schedule a hearing (usually in about a week) and at the hearing the court will give you a date to be out by. If you are not out by THAT date then the sheriff will come and remove you from the property.

If you force them to do the formal eviction it will give you a little more time, but it will also make it very hard to rent another place. You just have to decide which is more important - having a little more time or not ruining your rental history and credit.

I'm sorry you are in this situation, but there is not much you can do but find a place to stay. Most cities have a shelter, or a church mission or something.

Start packing the little things. Boxes, tape, start a load of laundry and fold and pack. Start packing now. Get dishes done and start shoving the glasses in socks to protect from chipping and just use plastic cups and such for now. Keep packing til you can't take it anymore and take a break. Then (get back to work. Don't sit for more than 1/2 an hour, you'll forget where you're at.


I am sorta in the same situation, but we found a place with a nice guy for a landlord, he's letting us move our stuff in early and letting us pay the security deposit in increments. We even got to negotiate the rent down from 500 to 450 for a 3 bdroom house w/ a basement and garage. And its not a sh*thole. We were planning on being out on Jan. 16, but she wants us out like, before christmas. We had to put up with mold, waiting 3 weeks for it to be taken care of, and then 5 days of construction workers in the house . And living in the space of a hallway while the furniture was out of the kids room (that's where the mold was).for 4 weeks. Everything is a mess, we can't sit at the couch, it sucks And to top it off, my vacuum blew its belt and the new belts won't stay on for sh*t. Oh, and the silverware drawer is jammed.

Sorry, I just had to get that out there. whew.

Call everywhere. Salvation army, St. Vincents De Paul, Habitat for Humanity, gavernment assisted living. See what they say and beg for help.
