I've got myself into a bit of bother. I'm behind on my rent as the council did not recieve the housing benefit forms. I really thought that my mother posted them for me, but they didnt recieve them. I rang my landlord today about a fault at the house and was told that my tenancy agreement ran out 4 days ago and I must now leave the property and hand in the keys asap. I have not recieved any notice to leave before today but they said they a seeking help on getting me thrown out. (cant remember the words they used. I have an 8 year old son and nowhere to go. I was wonderng if anybody had any advice or experience that could help me. (PLEASE DON'T GO GIVING ME A LECTURE ABOUT MY RESPONSABILITIES. YOU CANT CHANGE THE PAST.) What area are you in ? Are you in private rented accomodation with a short term tenancy ? If so, when did it start & finish (exactly) ? Are you on the Council Housing Waiting List? Have you ever had a Council tenancy before? Post more details & I'll look again soon**Thanks; Sounds like you should ask to have a Statutory Homeless interview at the Council not just hand the form in. Arrange this urgently as they can tell you exactly where you stand with regard to your current home. DO NOT just leave that home as it may go against you in terms of being what is called "intentionally homeless". Stay there at least until you have had the Homeless Interview referred to above. If you have a Housing Aid or Shelter Office in your area they too are good places to enlist some help. DO NOT JUST LEAVE YOUR CURRENT ADDRESS - IMPORTANT. |

go to your local housing office a.s.a.p explain the situation and they will help you , so calm down and pour yourself a nice cold drink , you will have somewhere to live happy with your son. thats 1 reason why the council is there for ......good luck.............. |

Get yourself down to the local council, and the CAB. They cant just throw you out on the street, they have to go through proper ways and get an eviction order form the courts, and that can take up to 4 months. In the mean time, get advice from a homelessness officer at your local council, and get more housing benefit forms filled out. Explain what has happened to the council, and get advice from the CAB. Good Luck, been in this situation before, its very worrying but with the right advice you will get it sorted out. |

If you are living in the UK there are laws in place to protect private tenants. First of all your landlord HAS to give you written notification of eviction stating the date by which you must vacate and reasons why they are evicting you. (But dont panic because you do not have to leave even then. )
When that date is up your landlord will then have to apply for a section 21 from the courts. This will give you opportunity to argue your case, in order for the landlord to be given a section 21 they have to prove a breach of tenancy and/or a valid reason for your eviction. IF the court accept your landlords argument they will give you a date that you have to vacate the property by.
Although this sounds awful, the time that this all takes will mean you can look for other accommodation. Your local council will have a duty to house you if you have children, but they have no such responsibility toward single people.
I have included Shelter's web address for all the information you need and I suggest that you contact your local CAB asap!

The one thing I do know is that they have to issue you with an eviction notice before they can throw you out.....see a solicitor who gives the free half hour clinic local to you and find out exactly what the position is.

There are procedures that LLs & owners have to go through to rid themselves of you.
don't run scared, but do run to your nearest legal advisor if you plan to stay without paying until you get kicked out buy the sherriff of notingham. |

Please check the advice given at shelter.org- your landlord must give you notice in writing and they cannot throw you out without a court order. Do not let him or anyone acting for him into the property. You are doing all the right things but shelter will offer you advice and if you phone them will talk to you and offer support. |

If they do not get a court order you canot be evicted. Everything has to be done through the courts. All this takes time. which is what you need. Tell your landlord you will not move out voluntarily and he will have to go to court. Apply to your council for a backdated payment etc. Explain your position they are sympathetic. Also go to citizens advice they are brilliant and will advise you on alternative accomodation as well as taking up your case. |

You must go to the citizens advice bureau, to find out what your rights are. I would think you require more notice than what you have been given, so you must sit tight. You can't be put out on the street when you have a small child, you definitely need more time, and I am sure legally you are allowed this. Good luck |

Get advice , do it quickly as I was evicted without notice , court order and in fact while in hospital . The whole matter cost me over 50 thousand pounds , the matter is still going on , only because I know that my local Council are that corrupt that they did nothing about it because the landlord used the same solictors as they did.

Unfortunately for him he has no rights. I presume you would have been offered a 6mth contrtact initially? Contrary to what a lot of people think you dont need to sign another contract after that - its called a rolling tenancy. If your landlord does not give you notice before the end of your initial tenancy then legally your tenancy continues for another 6mths. He now has to give you a minimum of 2mths notice written notice. Stay put, he cannot push you out without going throught the proper legal channels |

Surely you must be able to see your landlord's point of view too. He has a mortgage to pay and you have failed in your responsibilities, thus letting him down. For all you know you could have placed him into debt. Just goes to show that you should not rely on anyone else to do the job you should be doing. You could easily have picked up the phone to the housing benefits office and checked that all had been received and was being processed. Sounds like you want everyone else to dig you out of your problems to me. You cant possibly expect to rent a property and not pay for it. |
