Are you living in the house too?
If you are not, you have to evict via the courts.
If you live there you have to issue a 30 day notice (no such thing as a 3 day for a roomie) if they do not pay rent or only pay once a month. You issue a 7 day if they pay rent weekly. You need a police officer there to witness the service and issue you a report number.
30 days after that the police will come and remove them from your property if they are still there.
Keep in mind that there are certain people you can never evict. You can not evict your spouse. You can not evict anyone with title to the house. You can not evict a minor child of yours or your spouses. |

In most states in the USA you need to give them a 30 day official eviction notice. If you call the police, or try to have them wrongfully evicted they can sue you from what I understand.
However, it does depend if they are giving you any money or not? If they are not paying for anything I think that is called a "squatter"... Also it might depend on what state you live in...
Try googling what state your in and look up "tenant laws". That should help you more clearly.

If someone is living in your home, they are a legal occupant and are afforded the rights of a month to month tenant by default per your state's landlord tenant laws.
You must properly terminate their tenancy with either a one month notice to vacate (without cause or reason) or a Notice to Pay or Quit (for non-payment).
You cannot just kick them out or change the locks - unless you want to get sued. The police will not remove them.
The police will tell you that it is a civil matter and must be handled through the courts via eviction. |

First the person must have been staying there more than 2 weeks in the home to even be considered a tenant.
If they have been staying in the home more than the 2 weeks. You must give them a proper 30 day notice to vacate the premises.
If they do not leave in the 30 day notice then you must file a unlawful detain er. Personally i would ask them to leave prior to the eviction process. If they do not leave you must give a 3 day notice to pay or quit notice first before you can file any unlawful eviction process.

In some states a verbal agreement can count as a contract, but even that would depend on exactly what circumstances you told them they could live there under. Since they don't sound to be on any paperwork regarding the place, you should be fine to kick them out. Follow the example of jilted lovers everywhere and boot them. |

you can do that because everything is under your name.. legally that person is not entitled to stay in your home... try asking that person to move out. Since he is not your tenant (there is no agreement so i'll consider that) that means he does not have the possession of the house. So u can go ahead if he doesnt listen to you.
Remember tenants only have possession and not ownership. Both are different things however the owner (who has bought the house) has both ownership and possession

As long as they are not on the lease you can get rid of them immediately, if they are on the lease you have to give em 30 days usually. |

Sounds like trespassing to me. Tell him/her you're calling the police and they should leave. Otherwise, actually call the police and they should help you get rid of the freeloader.
