Pouring water off a Balcony, is this illegal?
I live in an apartment (condo complex where I am renting) and a person in the unit above me has twice poured water off their balcony onto mine. Fortunately I wss not on mine at the time. I am going to talk to the tenants about this, however I wanted to know if this is illegal, and - if so - who I should report this to. I suppose the local police could be notified, but I certainly don't want to call 9-11 and wondered if there was a regulatory agency that was involved in fines for such acts?

OK, I see some people do not realize that I said I am going to talk with them (i.e. advising me to do so is redundant and not helpful). My question is in regard to my recourse IF they continue to pour water on my balcony. And they do a lot at a time- it is not "watering the plant" - this is dumping a significant amount of water from a bucket.

I doubt there is a law, it would be local to your city if there was one.

No one would regulate this and you would not have a law suit, as you would have no loss. Anything on the patio is going to get wet, Mother Nature will dump more then a bucket of water on the patio.

Talk to the neighbor, they more then likely have no idea it effects you at all.

I would say its not illegal, but could be against the condo bylaws. I'd check on those. Talk to your neighbors and honestly, try to be civil with the person and ask them not to do that. If they persist, then bring it to the condo board. Then with a vote, they could say that person could not do that anymore. If he/she does than they could get fined or even worse booted out of the condo building. That is what a condo board is for. Your panel should have monthly meetings. If not, ask the president of the board to have one about this issue if it continues. But at first, just be nice and ask them not to do this anymore.

its only illegal if there is something in the water, or they are doing it maliciously. But definitely talk to them first and go from there..../

The chances of there being some law is remote. But simple courtesy isn't being followed. You might want to kindly let them know that you would prefer they didn't pour water or liquids over their balcony. Pin a not to their door if necessary. Be kind.

if the tenants are not receptive to your request, than try again in writing. be nice, courteous, and non-accusatory. it may be an honest mistake on their part. if this doesn't work, than talk to the landlord. if this doesn't work, get that in writing as well. do not call the police, as this is not something that they need to be wasting their time on (and quite frankly, they aren't going to do much about it anyways). i'm betting that once the landlord comes knocking on their door, they will think twice before pouring the water. they have a right to freedom, but not if it's infringing upon your personal rights.

It would likely not be addressed in the laws.

It should be addressed either in their lease (if they are tenants) or in the condo bylaws.

I think the water has to be soiled - like with human waste... - or worse for it to be illegal. There's no law against rinsing off your balcony.
Have you asked them politely to stop? When you ask them, record the date time and their response. Then I'd contact your landlord if it still doesn't stop.

They are probably watering the plants and you are getting the overflow.

Just talk to them.
