I have recently moved out of my rented flat. The landlord has advised me that I own him one months rent. I have disputed this and am waiting for my bank statements to confirm this (I am unwilling to pay him the owed rent until I have proof that I do in fact own it him). I have advised the landlord that if I do owe him rent then I will be more than happy to pay it.
My landlord has also advised me of damage in the flat (a dirty cooker and stained carpets), I am more than willing for him to keep my £360 damages deposit. But he has advised me that he has taken my ‘supposed’ rental arrears out of my deposit and will therefore bill me for the cost of the damages.
Can he take the rent out of the deposit?, as the rental arrears is still an ongoing issue.
Also can he charge me any extra costs after he has kept my deposit? |

go and see citizens advice bureau, its free and they are really good with this sort of thing. they'll even do all your correspondence for you and keep you updated. thing is carpets and a dirty cooker can be cleaned so why pay out xx |

Rental laws vary from place to place. In California, the answers are yes, and yes. I would place a phone call to your local housing authority tomorrow and ask them. |

If there is an owed amount then he is able to charge you for this, however you are within your rights to ask for a receipt as proof of costs that he has incurred due to you.
The rent due should be checked defo, did you pay a month in advance and then every month? |

I think that is what the deposit is for and if the cost of the repairs comes to more than the deposit i beleive he can charge you for this also.
Hope you come to some sort of aggreeement.
Might be worth you dropping into your local CAB (citizens advice bureau) to clarify it! |

he should wait, look in a situation like that let him know your mind and where he has gone wrong or stepped on your toes, then if he insist further, report him to your local Authority/ Government, compel them to look into the situation try not to step on the man's toes even though he is wrong, then report |

I wouldn't have thought it was an issue anyway if you can prove you have paid all the rent. Once you have proof via your bank statements, show it to him and he must refund what he owes you. If he doesn't write to him and give him 7 days to refund that amount and advise if you dont get a positive response in that time you will register a case in the Small Claims Court. Will cost you a small fee to do it, but if you win your case, and you will if you have the proof you think you might have, then he has to pay that back to you plus your expenses for attending court - i.e. half a day pay or whatever.
He has to put in writing what he has charged you for, with proof of how much it has cost him to put right. And yes he could withhold the rental amount, but if it is proved he is in the wrong he has to give it you back, and quick!
Follow this up because if it is as you say it is, you will have no problem getting your money back through small claims court - he will just hope you cant be bothered to do it. Good luck with this. |

Don't think he can do this, that is what your deposit is for! It is a risk a landlord takes when renting out a house (and making plenty of money out of you). He should have set a higher deposit if he wanted more for damages. Get down to your local CAB and see what they have to say about it but I think you'll find that you are in the right. |

He must supply VAT receipts for everything that he spends the money on, and then legally he can bill you. Get your bank statements and provide copies to him (and the leasing agency if there is one). Send him a letter detailing everything recorded delivery so there is no way he can claim he never got it.
If your rent is in arrears then he can bill you, if not then DO NOT accept it. Landlords always try to pull this sh*t and they get away with it cos nobody can be bothered making a stand. If there are any problems then go to your citizens advice bureau. If he doesnt provide evidence that he has spent the money then you can take him to the small claims court. |

the deposit you paid to your landlord,should cover everything if he didnt ask for enough to cover his own back thats his own fault,when i was living with my ex,the house we rented had some major electrical dangers,i refused to pay him any rent untill the problems were sorted he had no leg to stand on,as far as i am aware he can only keep your deposit,he would have to take you court if you refuse to pay any more to him,chances are he wont bother. |
