Problems with landlord?
We have been living in a property for 7 months now and our shorthold tennancy has just switched to 'month by month'.

do they have to give 1 month, or two months notice? also can they come and change the locks while we are still living in it?

p.s. we have not broken the agreement, we have been good little tenants, the only reason we are being kicked out is because my partner has had an operation recently and is still recovering, so he is on incapacity for a few months untill he can walk again.

just to add, yes we are still paying full rent and it is always on time and in full.

Its a load of rubbish this month-by-month renting. You can be legally booted out with a months notice. Those landlords are nothing other than wide-boy parasites that are allowed to do what they want unfettered by the law. Stand up to this person and tell him/her what you intend to do. If they want to get rid of you then they will, but at least you will tell them who is boss. A lot of the time they are just hopelessly optimistic twats that don't know what they are doing and are only investing in 'pension-properties' which they will sell anyway. On the whole though they are lower than a snakes bum and deserve a good shouting at. At least.

Hi,
You get good landlords and bad landlords, and I as a landlord would suggest that you speak to welfare rights adviser or similar, they could advise you on your own personal situation and enable you to secure your position in your current home. Why would they change your locks? Maybe you should remind them that they should also give prior notice if they wish to visit the property, who do they think they are? That's what they get paid rent for so you have rights please seek advice on the matter, you may be better off than you think.xx Good luck.

Why would the landlord care if your partner had an operation and is recovering ??? Landlords care about two things, rent being paid on time and tenants who maintain the property quietly. Are you sure you are doing both?

I'd get a lawyer. as long as u are keeping the agreement which I hope u read and it doesn't say anything concerning this in the contract. he should give u 30 notice then the law gives u 60 day notice which means u actually have 90 days. I would give a lawyer a call right away. at least thats what it use to be.

I'm not really sure but....... It may state that they can switch to month to month payment but i believe that is illiegal without notice. Read your originall contract very carefully. And the only way they could change your locks is if they give you a set of keys if you are still a legal resident on the property. Or if they have evicted you then they can also. I would call a lawyer and get a free consult to see just what the hell is going on. Good Luck.

You and they have a statutory right to a minimum of 1 months notice in your situation.ie first 6 months garuanteed after then month by month.
As for lock changing check up on your tennants agreement ,see the letting agents or better still go to the CAB now/tomorrow.

There has to be a months notice to change any tenency agreement..changing locks while you are still there is illegal...you could sue.
But this is California law..check with your local or state housing authority.
As for the eviction..as long as they give you a 30 day notice it's legal.

leasing carefully.landowner do not create trouble.is the tenet that create the troubles 95% if you pay you rend ,their is no trouble. in very hard for me to believe that the Land owner change the lock,land owners know the low and they follow the lows,if they violate the low they can be in series problems,land owners do not lock tenna an-lest tenet buttoned the premises and they go through the court pr-asses
