Problems with our rented house?
My boyfriend and I moved into a rented house in January. From the start we had problems with it. They kept putting off the moving in date because things weren't finished etc and then when we did finally move in they were still fixing plumbing, floorboards etc. This was all sorted eventually and although it was annoying due to the fact they'd promised us a moving date and we'd moved 200miles so had to stay in a hotel until it was ready, we were just relieved for it all to be sorted in the end.
Anyway that's some background on what the agency is like.
About 2-3 months ago loads of the fencing was blown down in the garden. Not just a few planks, whole panels that are lying all over the place. We are a middle terrace so now have no privacy in our garden from either side. We have been asking and asking for them to sort it out but they still haven't done anything. We didn't pay the rent this month on time and told them we'd pay it once they'd got it sorted. Continued below!

They promised that it would be sorted within the week as long as we paid the rent so we did and surprise, surprise it hasn't been sorted! Are we being unreasonable expecting them to fix things like that? It's just we really want to be able to use the garden now that the summer's coming! If you've read this far after my babbling then thank you!!

Is it his fence?

That's the first point, if its not its up to the neighbour to repair it.

Withholding your rent is not a good way forward as you leave yourself open to eviction for non payment.

Carrying out certain kinds of repairs
Landlords are responsible for most repairs to the exterior or structure of a property. This means that problems with the roof, chimneys, walls, guttering and drains are the responsibility of the landlord. Landlords are also responsible for keeping the equipment for supplying water, gas and electricity in safe working order.

Tenants often have responsibility for some minor repairs and maintenance. This usually relates to:

internal decorations
gardens
furniture or equipment
Check your agreement to see what it says.

This is a link to Shelter its a charity to help tenants who have housing problems, including landlord/repair problems, but first read your lease and see what kind of tenancy agreement you have and find out if the fence is part of your property or your neighbours.

Its not unheard of for a neighbour to get quiet and hope the other person repairs a fence not knowing its not their responsibility.

I'm not sure about rules but our landlord gave us a list of how long time scales would be for repairs when we moved in. So emergency repairs were 2-3days e.g. boiler breaks (this happened before xmas and they fixed it the same day) then up to 6 months for non-emergency repairs (e.g. wobbly floor boards etc). It'l probably say in your contract somewhere whats going on.
To be honest though if we have something annoying we just fix it ourselves - quicker

It is possible that your landlord does not know of these problems. If the property is fully managed, then the landlord will only know what the agents tell him.
Put in writing to the agents that you give them 7 days to sort the problem, and ask for the landlords address, the agent is
must supply written details within 21 days by law. You may like to do this first, it might be enough to get something done.
If nothing is done write to the landlord with all the points and say that the agent is unco-operative.

Unless your contract stipulates that you are responsible for repairs, it is down to your landlord sort this out. They are in breach of contract and you are quite right to withhold rental payments until this is sorted.

I would get 3 estimates to fix the fences and present them to the landlord tell them that you will withhold the amount of the most expensive (Plus a percentage fee for your time and effort) from the next rental and get this work carried out yourself. Give them a deadline, after which you will instruct the work. If the landlord gets the work carried out, make sure it is done properly and not on the cheap.

If you had a lease that stated a start date/moving in date then you can claim back the money you spent in the hotel as that would be breach of contract. Although you may not get the full amount back. Typically it will be the nightly hotel rate less the daily amount you would have been paying in rent (e.g. if your monthly rent is £900 and there was 30 days in the months then it would be £30).

As for the house still being in a state of disrepair then you may be able to receive compensation for that too providing that the building work interferes with your use of the building. Most leases will have a clause that allows the landlord to make alterations but if these go on for a long time you should be able to get a discount on your rent. Best idea is to take as many photos as possible of the conditions (don't use a digital camera or mobile as some courts will not accept these. Buy a cheap disposable camera instead) and get witnesses who will vouch for the condition. Take this to the letting agent as demand it be resolved or you want a discount.

If this fails contact your local CAB (numbers online or in yellow pages) who will be able to give you free professional advice.

pull out ur contract and check to see whos responsible for maintanence and fixing problems.

start documenting the things that went wrong, when you reported it, who you spoke to and their response. best do this in a diary, try and take fotos too

keep your receipts or statement saying you paid for the hotel to stay in because they werent ready for you despite the move in date lapsing

write a letter to the landlord detailing the problems you've had, list all problems, and how they havent been resolved and tell them youre going to citizens advice for consultation (and actually do it)

basically, you wana give the ultimatium that they have to
1 resolve issues
2 reeimburse you for the hotel costs (its their fault)

and tell them until the current problems arent resolved you will not pay the rent (provided CAB agrees)

it might be worth ur while speaking to a solicitor to get this stuff sorted. If its a private landlord Im not sure exactly where u stand but if its a registered landlord you have rights

Write to them stating that you will get a fencing contractor in to do the required work and will be deducted their charges from next months rent. Make sure you send it recorded delivery so there is a signature got for it. Good luck - ohhhh and you need to follow this through if they don't respond within the seven days you stipulate.

I think what you should do is talk to your neighbours each side as they probably want it fixed as much as you do, get them to write a letter of complaint to the agents, I'm sure they will then get their finger out and do something

ok firstly if it wasn't in the contract to fix it they wouldn't have said they would so obviously their responsibility........

secondly now you know not to pay them next month.........wat you could do is hire someone and get them to bill the agency for the work........inform the agency of this beforehand.....maybe this will sort it

no your not babbling your paying a lot of money for rent its your new home and you have rights remember

Get in touch with the Tenants Rights department at your local council. I had a dodgy landlord a few years ago and he left me for 2 days with water dripping through the light fittings. Anyway I contacted tenats rights and they investigated him, made him do all the work neccesary, immediately, and even caught the dodgy git out on a council tax scam.
