Property left by tenant, to be moved whenever?
An ex-roommate has agreeably moved out. He has left numerous vehicles, boats, trailers, lawn tractors, etcf. some in working condition, and my acreage littered with other items. A garage full of equipment (can barely walk through), some furniture, TVs. He is taking his time moving them and I want them off of my property. He refuses to pay storage. What can I do? Send him a certified letter that he must sign, stating he has 30 days to remove his property or it will be disposed of. The letter carrier will leave a note in his mail box informing him he has a certified letter waiting for him at the post office if he is not home to sign. You do have to make some effort to notify him that you plan to get rid of his stuff.

As above - but get the legal system on your side -

Even though he amicably moved out - he did not take his stuff
so go to your local courthouse on Monday - Judicial section
where they deal with evictions and file paperwork to be served on him

he should have 3 days to a week (depending on your state)
to get his stuff - or you can dispose of it -

ask your helpers there what North Carolina law provides for your relief

Not sure about NC but I am in SC. Here he doesn't have to move anything out until you serve him with an eviction notice. You may call your magistrate though to see if it is the same there. GL

take him to court and they will make him remove the property. If he doesnt by the date the court gives him then you can have the property moved yourself. Make sure you get reciepts if you hire someone to do this. Then you can sue him in small claims for any money you paid to remove his stuff.

I'm not sure what NC laws are regarding this type of situation, but typically it is set so that the tenant has a certain number of days to remove their property after he/she leaves. If the stuff is not removed in that time, it is considered abandoned property and you can do with it what you wish.

Definitely contact the courthouse on Monday and ask them if they can provide you details and procedures to get it settled.

Every state has different laws on this subject. You need to check your states tenant land lord laws.

In my state you give them 14 days notice to come get it or it will be disposed of .

Notify your ex-roommate that he has one week to clear your property. Then have the police/sherrif write up an abandonment paper on his things. After the time limit is up and in Utah it was 3 days, then it's yours to dispose of it as you like.

Confirm local law for the official terms of "Abandonment." But I'd notify him if the stuff isn't out within 30 days you will consider it abandoned and a gift to you to sell, give away, discard or otherwise dispose of. Then, if there is enough usable stuff hire an auctioneer.

There are abandoned property laws in every state. I do not know the time frame for NC but the concepts are the same.

You need to send him a certified (so you have proof he got it) letter stating that all remaining items will be removed with in x # of days. If he has made no arrangements to get it or contacted you at all by the deadline then you can trash what ever is trash and sell everything else. Now you cannot just keep any proceeds, unless he owes you money, then you can only keep the amount he owes you.

Give him a deadline to move it all out. If he doesn't have it all out by that deadline you can start selling it.
