My tenant is an annoying rascal who has a sex offense and constantly calls me about every little problem he finds in my condo. He does pay on time every time, but I need to get rid of him or I won't be able to have a property manager dealing with better tenants while I'm living in another state.
I need suggestions on how to get rid of him without him taking me to court, please! 'Preciate it! Additional Details It's a fixed term lease--5 months left. |

Assuming he's on a fixed term lease -and not violating it somehow- your only option is to approach him, and ask if he'll agree to end the contract early. If he's not open to it, then you're SOL. If he is open to it, be prepared to negotiate, but he's got the upper hand here, and you'll need to meet HIS terms. I'd offer him 30 days rent free once his 30 day notice is put in, and full security deposit returned _as soon_ he returns possession, granted there's no major damage.
If you don't want to take the financial hit, let him stay. Property management firms are used to problem tenants; it's part of the job. If the property management firm you'd like to use doesn't want to take your property b/c of his SO status, shop around. Somebody WILL work with you. |

if he is paying as agreed and following the tennets of the lease, than you are stuck with him until the lease term is up. when it is up, than simply do not renew said lease. keep in mind though that you must give him 30 days notice of your intent not to renew. sit tight until then. |

Depending on where the property is, you don't need to give him notice because of local ordinances that regulate where sex offenders can live. If the property is in a restricted area for sex offenders and you knew he was one before you rented to him, you could get fined by the local municipality. |

When I was involved in rental property you could give someone notice that you wanted them to move out in 30 days but only if they didn't have a lease.
Odds are they will then trash your property, with luck you will have a large enough deposit to cover the damage. |

We need to know what kind of lease he has.
If he is on a month to month, then just give him 30 days notice. You do not have to give a reason.
If he is on a fixed term lease then it is quite a bit harder. |

You can give a 30 day notice to resident and not have to give a reason.
If they take it to court which I doubt because he will be frowned upon by a Judge then you just tell the Judge that you do not want to be responsible for this tenant in case he does something to a current resident. If he does and you know that he is a sex offender- you will be held liable. |

You could always just raise his rent to cover the hassle when time comes to renew the lease. I mean, if you have a tenant that pays, but maybe requires a little bit more attention, just charge him accordingly. Then you can pay the property manager his/her fee to handle the client and still be assured that you have a tenant that pays on time every time. As for the sex offense, if he paid his dues giving him a second chance is an admirable thing.
