the landlord does not care which one pays the rent. the landlord wants the rent.
if your "bf" firmly wants you to leave, ask him to sign an agreement . This agreement states he will pay the rent and releases you from the tenant lease ; or to sign an agreement that you can sublease..
this will not release you from the present lease with the landlord..but will give you grounds in a "civil /small claims" action. |

Both of you are fully responsible for the entire rents. If he doesn't pay, you are responsible for the full amount, and vice versa. If you elect to break the lease and face lawsuit, BOTH of you will be sued for the full amount owed.
That's the way joint leases work. |

If your name is on the lease you are responsible for the rent - you can talk to your landlord about having your name removed. Do you think your boyfriend will go for that? If not try to have him get a new roommate that can put their name on the lease and pay half of the rent. I would not move out without having your name off of the lease. Any damages that happen to the apartment after you move out will be your responsibility. |

If he wants you out then he should be responsible for all of it. You are both on the lease so you are both responsible. However when my ex and I split we went to the leasing office/ landlord together and he asked to take full responsibility for the apartment. They let me off the hook because he wanted to stay there and wanted me out. I also didn't want to be responsible if he decided not to pay or caused damage at the time that I didn't live there because then I would still be stuck with the bill. They would probably do this because they don't necessarily care as long as they are getting their money. But it would be total bull for someone to say I dont want you here but I want you to pay for it anyway. Go talk to your leasing office and tell him to sign a roommate release form. If he wont then stay... and make his life hell =) |

Since you are on the lease, you are still responsible for your portion of the rent. Talk to your landlord and see if you can be removed from the lease. |

You're responsible for all of it. The landlord doesn't care which one of you pays it, he/she just wants it. So if you move out and your bf doesn't pay it, then the landlord will come after you.
This is why it's a bad idea to live with someone to whom you aren't married. |

You signed for half the rent. That's what you owe. If you move out and trust him to pay the whole rent, you are fine. If you don't trust him to pay, you stay and he goes. / |

Unless he re-negotiates a new lease with just him on it you are still responsible for the next 5 months! This happened with me 10 years ago. I left and thgen after a few months he moved out too! The management company garnished my check and I had a negative mark on my credit report! I strongly suggest you not leave until you have gotten off that lease! |

Do not leave before you get your name off the lease. Once you go, he can lock you out and still make you pay for the place til the lease is over.
Ditto the not playing house before marriage concept. That is one easy way to mess up a credit history. |

If you're on the lease, you're technically responsible for the another seven months. However, if the living situation has become untenable, the LL may allow you to buy your way off the lease.
If you leave without removing your name from the lease, you will be co-responsible for the rent along with your exbf. If he defaults, the LL may come after you.
Discuss the situation with your bf. If he wants you to leave, he needs to know that he has a responsibility to mitigate his losses by trying to get another roommate. And you should make a good faith effort to find someone before you leave.
This is why unmarried people should not play house. |

if he fails to pay and gets evicted or something then they are going to send half to collections for you and half for him. Only thing you can do is talk to the landlord just to be safe or you can take the risk. |

Legally, you owe half the rent. But it depends on if the signed agreement (contract) says if you guys have a joint payment rate (You both pay half the rent) or one of you say that you would pay the whole thing. |
