Question about defaulting on mortgage?
My neigbhor is really sneaky and has lots of police problums and such. one day she called me and asked me to look out the window to see if her boyfriend was home. when I looked out the window there was a sherif at her door so I told her that. he had left a note so she asked me to read it. when I went and read the note it said she had defaulted on her mortgage and had to apear in circuit court oct 3 and it said something about forclosure. She called me later and said it was because she had just switched mortgage companys. was this a forclouser notice?

This depends partly on what state you are in. There are "Mortgage States" and "Trust Deed States" and both have different foreclosure procedures.

In neither case is this a foreclosure notice. having a Sheriff come to the door and leave a notice is far beyond that. Foreclosure notices are normally done by mail, sometimes registered mail.

If you are in a mortgage state, then this is a subpoena for her to attend the actual court hearing to have your neighbor's house foreclosed on.


If this is a Trust Deed State then this is probably an eviction hearing. Her property has been foreclosed or in the last days of foreclosure, and she is in the final process of being evicted from the house.

The Oct 3 hearing would be the final action, with her getting a chance to show cause why she should be allowed to stay in the property a few extra days/weeks, or to move out immediately. if she doesn't go, in all likelyhood the next time the sheriff comes it will be with a crew to move all of your neighbor's items to the street (actually storage) and lock her out of the property.

Like many people today she probably had an adjustable rate mortgage (a mortgage where the interest percentage rate changes) and when her mortgage rate went up she ceased to make the payments. Or she stopped paying her mortgage for other reasons. Basically foreclosure means that you will be evicted from your home and your home taken from you.

When you are evicted the authorities are the ones serving the notice to appear in court, if you refuse to vacate your property voluntarily the cops come to your house and throw you and your stuff out on the sidewalk. Laws will vary from state to state.

If the sherrif came with a note she is more than a couple months behind on her mortgage, yes she is pretty much getting ready to go into foreclosure.

Sounds like it but I never knew that the sheriffs dept would come knocking on your door to let you know that it was in foreclosure. But I guess someone who have to do someting like that to get you to gt out of the house. That is a good question

If a sheriff delivered it, it was likley a letter called " Notice of Intent to Foreclose." This means that the lender / bank is starting the foreclosure process in the court system (or has already started it). If your neighbor doesn't make any settlement or payment arrangements by the time they are due for their court appearance, the court will issue an order allowing the bank to foreclose, and the home will be auctioned.
So you are aware, it takes several months of non-payment (default) before a foreclosure is implemented; therefore, your neighbor probably hasn't made a mortgage payment for a while.

More then likely, each state dictates notification to homeowner, most states will post sheriffs sale on the property in question, along with notification in a publication known as the Legal News, as well as the legal section of local newspaper.

More than likely, yes.

You can check it out for yourself, by checking the sheriff's department's foreclosure sale list. See if her property is on the list. Some counties list this information online.

Yes it was. Different states have different requirement for delivering eviction/foreclosure notices. You should not have gotten involved at all. If she was sneaky with the cops do you think she told you the truth about changing mortgage companies?

Sounds like your neighbor is a liar. Who wants to admit they can't afford their house anymore.
Tell her she'd better show up to court.
You don't just switch mortgage companies without them knowing it, so she's obviously living way out there.
You could buy her house at a great price, then rent it out and enjoy instant equity.

i dont think a cop would leave in on the door. Not sure how that works exactly... buy the house cheap... sounds like you dont need them living there anyways!!
