Question for tenants or landlords! What are my rights?
The lease on our apartment just began yesterday, and it was our first time into the apartment since we quickly had the one and only look at it a month ago. At the time of looking at it, the apartment had been vacant since April, and still needed to be cleaned (desgusting carpets) and painted, which they said they would do. Upon arrival yesterday, we were not overly pleased to find extensive wall markings and chips (including tacks still in the walls!), and the carpet incredibly dingy, dirty, and with more burn hole (cigarette size) then we could count. We called and asked if the carpet was cleaned, and they said it was. If this is the state of the carpet AFTER being cleaned, should it not be replaced? Can we force them to paint, or even paint ourselves? We are filling out a report about the apartment condition upon arrival... and taking plenty of supporting pictures!

These are all great answers. I hope its all usefull, because I live in Canada, and I know the laws could be different... The really frusterating part is they make you sign the lease before everything is done in the apartment... like you sign it a month before hand, and they have that time to get it ready. If you refuse, they just find someone else...

Your right vary from state to state and even city to city. You will be able to go online and fined the answer, put in renters rights and the name of the state first and the list will come up. Documenting everything is important and many states allow you a grace period to leave the contract 1 day to 1 month so HURRRY>....

I would call your landlord and ask if they mind if you paint the place. As far as the carpet goes...id tell them you are very upset with condition of the carpet which you were told would be replaced. There are burn holes and it is their job to replace these items. If they refuse i dont think there is much you can do. Just make sure you keep your pics of the damage so they dont come back and try to say that you created the mess. Good luck. Sounds like youre in for quite an experiance at this place haha!

If you got the promise to clean and repair in writing, you may be able to vacate the lease, but you will still need to find a place to live. If not, you can continue to request that the repairs be made- if you have difficulty you can get your local housing authority involved until the apartment is up to building code. Otherwise, not much you can do unless they let an unsafe or unsanitary condition continue. Even then, you would have to go to court to force repairs, or escrow your rent until repairs or complete. Consult an attorney for specifics in your state or city.

If in the USA: Check your state's General Laws, under tenant/landlord rights & responsibilities. Arrange an inspection by your local Board of Health and cc your landlord on it. The BOH can be the arbitrary factor in deciding whether you can make demands upon the landlord for issues with rental condition. Sometimes you can withhold rent until repairs are made -- but you will eventually have to pay that back rent. However, if the BOH finds that the place is not a health hazard, then you are kind of stuck. Maybe the landlord will let you out of the lease and you can move elsewhere. Next time, take a better look before you move into a new place.

Sorry to hear about your um, "new" place!

You're right to document with pictures. Prove the dates of the pics as well.

But can you force them to paint? No. As you signed for the apt. it was your jobe to visually inspect the place & therefore choose whether or not to sign the lease for it.

You need to check with your lease agreeement to know whether you'll be allowed to paint it.

It's also the landlord/property management company's responsibility to make the place for rent "habitable" so for all intents and purposes, you may have a point; You'll just be required to pay rent while you make it.

Actaully if you already asked the office to clean your new home and everything still look bad upon arrival, I would confront the office again to have everything painted and cleaned again. If they refuse you can call the local Dept. of health and the local housing authorities and let them know of the situation to see what can be done to make your apartment your new home.

The pictures are a great thing. Make sure the camera has the date on it when you take the picture. This way you have proof of the markings and the date.

OK, I rent out my home and this is what I have found...about every 2 years, a home should be repainted (but is not required) As for the carpet, if it is a severe "health hazard" such as mold and such, then yes it must be replaced. It is very hard to give you the exact facts when u didn't state where you live, each state and county have their own rules.You can go on your county's website and they have the laws there. Or you can go to your local PD, ask for a supervisor and ask them to advise you of your rights. They'll give you the complete rundown. The landlord may not known either, so if the carpet is the only problem, then try to work it out before things get out of control.

Double check your Lease to be SURE it doesn't have an 'As Is' clause in it.
It also depends on your State's Rental Laws re: Verbal Agreements!

They don't have to replace the carpet. But you are doing the right thing by taking pictures. Also, there should be a walk-through inspection that gives you a couple weeks to put in writing all that is wrong. This relieves you of any damages when you move out. You should keep in mind that you might be able to get out of this lease if the condition is not as specified in the lease. Try doing some Internet research on landlord/tenant laws for your state.

You are definately doing the right thing by taking photos of the carpet and the walls for your files. You don't want them to come back at the end of the lease and charge you for something that you didn't do. The landlord said they would clean the carpet and they probably did, yes it needs replacing but if you didn't ask them to replace it and they didn't agree I'm afraid you are stuck with it.

I don't see why you can't paint the apartment yourselves as long as you paint the same color, however, if you choose to paint it a different color you will have to return it to it's original color upon move out or they will charge you to paint it back.

You can't force a landlord to do "cosmetic" work, you have no leg to stand on as far as cosmetic repairs, only serious repairs like, plumbing, electricity, A/C, stove, fridge, toilet, broken windows, mice, roaches etc. would warrant fines from the city housing authority to repair. Burned carpet and marks on the wall, I'm afraid you'll fight a losing battle on that one.

Same thing happened to me. My fridge was full of mold, and many of the things you listed. Our apartment manager gave us $200 off the rent because we had to clean it our self. They can or can not change the carpet. What ever they want really. Just make sure you keep those photos because apartments are notorious for letting you move in with burn holes all over and then charging you to clean/repair the carpet when you move out, knowing damn well they never use the money to clean or repair it. If you feel it is completely disgusting then talk to them. If they refuse to replace it then do it yourself and send them the bill and take off the amount from your rent owed. As for the walls, they are suppose to paint them each and everytime someone moves out. My landlord said we could paint any color we wanted as long as we painted back to white before we moved out.

ASk for you money back. If they refuse take them to court. They will be no different after you movee in and then your right deminish. The landlord is the one the court supports because he is the one who pays tax.

You are doing the right thing with the report and photos, unfortunately you can't do anything verbally as it is extremely difficult to prove anything. Usually you can paint but you have to ask the landlords permission to so. What I would do is get someone to come and observe the place and obviously get their report in writing and then follow up from whatever they say in their report with a letter to your landlord. If the observer thinks the place has not been decorated sufficiently this may make the landlord take some action.
Alternatively get him to come round show him everything and explain that until this is sorted you are holding your rent until he does something about. By law he can’t kick you out on the spot as he has to take it through court.

Check your lease or your contract with the apt complex. It may have answers in it. Also...find out which carpet cleaning company they go through...contact that company and ask them yourself if they cleaned your specific apartment.

Good choice in taking the pictures etc.

I'd fight it though.....

You should definitely approach the Landlord in a calm and firm manner and tell him that the rug and paint is unacceptable. Usually when a landlord rents out an apartment they are supposed to put new carpet and paint for before the tenant moves in. Unless he is Scum lord.
