Question regarding my rent check...?
I paid rent on the 5th and knew my account balance was low but was getting paid on the 10th. my bank notified me that a check bounced due to low funds and they weren't going to let me overdraft, especially with the bank issues these days. it's now the 15th and my manager still hasn't given me a notice that my check has bounced, even though i know it has... isn't this her responsibility to tell me "hey, you owe me your rent!"?? i have the funds, plus extra but she doesn't return my phone calls + im not home during her business hours. in my past rental experience i've had a note on my door (only happened 1x before) saying 3 days to pay or get evicted... and this hasn't happened yet. should i keep waiting for her to leave a note/call back or what?

well my lease is up the end of november and she knew we wanted to re-sign... the vacancy rate here is very high (theres only 70 units and 10 of them are vacant!) so i dont see why she would want to evict us knowing she's just screwing herself and her employers... when my neighbors check didn't go through he had a note on his door (for sept. rent) so whenever i come home from work i anticipate seeing a note too and haven't yet... besides, SHE hasnt returned my phone calls and i've called her 3 times since last weds...

Could be the landlord hasn't gotten around to learning your check bounced. Or, that the check was presented again, and cleared. I would talk to the landlord about changing the due date.
Or, explain that the money won't be in the bank until the ?? date.
Or, call the bank and see if the check has cleared.


Or, be sure the funds are there before writing the next check.

It's your responsibility to pay your rent. A good property manager should have put a note on your door, but just because that didn't happen doesn't mean you should do nothing about it. Take off work early, or ask for a day off to go speak to her. If you can't, drop off the rent with a note attached. Like I said, it's your responsibility to make sure you have a place to live.

No it's not her responsibility to notify you, you under your lease obligation are responsible for making your rent on time. You need to notify her that the check didn't clear and that you have the money and the late fees and bounced check charges to pay her (via money order) I doubt she'll take a check and when is a good time to drop this off.

You have to make the time to run this errand and hand it to her in person. NEVER wait until you get a three day notice, too many of them in your file will work against you when you either renew or move out. If another landlord finds out they had to constantly chase you for the rent they will not rent to you.

Take some personal time off of work and fix this otherwise it might just be an eviction notice you find and not a three day notice.

Her vacancy rate is not very high, she is 86% occupied at this time and that's not a bad vacancy rate, if she had only a 70% occupancy rate then yes I can agree. Regardless of that the landlord doesn't see vacancy they see a tenant that bounces checks and doesn't pay rent and someone they might consider NOT renewing.


this is harder than it looks.
A lot of the time the bank takes a good long time to notify the landlord that the check has bounced. I know that from checks paid at the begining of the month we would always get the notification around the last week of the month. and then we would issue the 72 hour notice after that.

With the company that I worked for we were not allowed to take new rent from the person until we got the NSF notification from the bank... this was just due to incase the check did go through or what have you it saved a head ache on both parts.

and to answer your question. No you are responsible for making sure that your rent has been paid. The landlord is not a baby sitter. Think of it... what problems does it cause for the landlord if you don't pay rent... now what problems does it cause you? a whole heap more for you. I would be a bit more persistent in finding out what is going on and getting your rent paid.

EDIT:
Still your responsibility... but hey it's just your credit and rental record on the line.... Just giving you a dose of the truth... and if you didn't want to hear it then don't ask the question.

And how could you possibly think it was anyone elses responsibility to get the money from you when YOU wrote the bad check?

Since passing a bad check is a felony in most states, it may be that the landlord is pursuing a criminal charge against you. Either way, you will get some sort of notice soon enough.

No, it's not the manager's responsibility to remind you that you still owe rent. I suspect her or she is looking forward to evicting you.

As an account holder of multiple business accounts-we, the landlords are usually the last to know about an NSF check. It takes 10-15 days before we get the paper statement on it. The only way to know sooner is for us to go thru our accounts on-line and then you only have a dollar amount with no real idea which Tenant bounced a check.

I appreciate it when my tenants let me know as soon as they know. Then I am willing to waive late fees. Otherwise, I hit them with every charge allowable.

Are you sure she didn't just run it through the 2nd time? If not then you need to get in touch & make arrangements to pay before they call you. It makes you look better if you do.

It is possible that she has not received notification from her bank about the check being returned yet.

I think that it is YOUR responsiblity to get in contact with the landlord. If I had bounced that check, I would have been on the phone immediately with the landlord and telling her that I would bring her a new check right away. But thats just me.
