GC | Re: Penal Code 602.5. I evicted a tenant from a 9-plex. Is it considered trespassing if she visits a friend? |
If a tenant was evicted from a 9-plex, and she visits a friend who is still on the property, is she effectively trespassing? I own the property and I don't want her anywhere near it. But she has a friend who also resides on my property. Can I legally stop the evicted person from trespassing my property, and essentially prevent her from visiting any of my other tenants? |

No.
You don't have the right to approve or disapprove your tenants friends. You aren't running a prison camp.
You own the property, but you don't own your tenants lives. |

No Not by law you can't because the other tenant technically by leasing the apartment owns it for the period paid for. Further any clause prohibiting the evicted tenant from visiting another renter would be considered illegal and actionable. You aren't even allowed to talk to or question the evicted tenant unless said person is involved in illegal activity such as vandalizing or stealing from the premesiss and even then you are only authorized to contact the police.
Be very careful if you speak to either of them as it could easily be misinterpreted as harassment |

No, since you are renting your property to other people, you are relinquishing a portion of your bundle of rights to the property. Your tenants are more than welcome to have anyone they want over. If the tenant was violent towards you or threatened you in any way and assuming you live in the complex, you might could get a restraining order against her, which will produce the desired results.
Personally, I would keep her around as an example of what happens if your other tenants don't pay rent! ;)

when you evicted her from your rental unit, if she moved she is no longer a tenant, unless you get a restraining order against her she can visit the property as long as the other tenant invites her to her unit. you have to go to court to get the order, until then you legally can keep her from the property. if she is destructive while visiting you can call police and they will arrest her and advise you to get a restraining order........... |

Ugh, what a headache! I feel for you because I know exactly what you are going through. And everyone is right, it is unfortunate but you cannot stop them from visiting and friend that has invited them. "Invited" is the key word. They cannot just drop by and cannot solicit or loiter.
Good news is that they have just tipped you off on where your next vacancy will be. Birds of a feather!
Get your paperwork in order for court and your contractors lined up to turn the unit. |

Depends on what you mean "evicted". If you evicted her from "renting one of your apartments" (i.e. she didn't pay) then sure she is allowed to visit other people in your complex.
If she was causing havoc orcriminal activity on your property and you called the police and had her removed from the property by the police, then that's a totally different situation, in that case she cannot visit. |

She is not an authorized person to come there, I think that you can keep her from coming to your property but here is a clip that is found in that penal code.
If a person is convicted of a misdemeanor under subdivision (b), the sentencing court shall also consider issuing an order restraining the defendant from any contact with the victim, that may be valid for up to three years, as determined by the court. In determining the length of the restraining order, the court shall consider, among other factors, the seriousness of the facts before the court, the probability of future violations, and the safety of the victim and his or her immediate family. |

once evicted, the evicted tenant is usually notified by the sheriff that they are not to return to the building of it will be considered tresspassing. let her visit her "friend" outside of the complex. You are the owner of the property |
