It depends on what state you live in but most jurisdictions require a minimum of thirty days if you pay month to month. For example California requires 60 days notice if you’ve lived there longer than 1 year (as in your case) The legal theory behind 30 day notice is that rent is paid in advance, so when you paid rent on the 1st that entitles you to possession for an entire month, period.
It sounds as if someone dropped the ball and never noticed you of the sale. If it were me, I’d demand ALL of my rent back for that month, then move, or demand your 30 day notice. At this point the real estate company will more than likely pay you some $$ just to go away. They don’t want to risk loosing this sale.
They are playing hard ball but they have no leg to stand on. Check with your local legal aid as to what their notice requirements are. Your douche bag landlord is making plenty of $ off the sale, so just tell them to spread the wealth or your not moving !! (but check your local ordinance first) |

if there is no lease, then you are on a month to month, that starts on the 1st of the month. If they gave you notice to move in mid Jan, then you have until the end of Feb to actually move. The lease agreement runs with the property, not the owner. |

Most states have Landlord-Tenant laws. You/or your attorney will need to check your rights. If you choose not to buy it, you'll need to move. It shouldn't cost you anything to attempt to purchase it if you have a desire to do so. It certainly will buy you time to develop a plan to go elsewhere in the event it doesn't work out for you. In this market, you may be the best option for the seller. |
