Realtor / Listing agent submitted a wrong offer!?
After placing several offers on a bank owned property we finally received word that our highest and best offer was accepted. The banks listing agent sent us the banks purchase agreement and it had the wrong purchase price listed. A little over $9000 more than our offer! The listing agent then tried to tell my realtor that the price was exactly what we submitted to him, only later to recant and apologize for HIS error. Now the listing agent is telling us we will have to resubmit our offer, but to expect a counter offer…

What should I do? Is this common for a listing agent to make a mistake like this???

This is a Bank owned property or REO. The listing agent just sent meand my realtor another email stating again that the error was HIS and that he contacted the bank and is waiting to hear back from their assets manager because they have not dealt with this kind of error before.

What really ticks me off is the listing agent told us to call our lender so that we can get the appraisal done ($340) and close within 20 days... Now I am out $340 if this goes bad...

First off, I'd collect all of my paperwork that shows what offer you truly submitted. I would see if you had any written proof that the listing agent admitted his error.

I would then have your agent contact the broker owner or manager of the listing agent and let him know what exactly the problem is. I would explain, in simple terms, and in writing, that you expect to be purchasing this home, at the price you submitted, and without resubmitting another offer.

I would also explain that if the seller (bank) expects the higher offer, that you will be expecting the listing agent to pay that amount. If they do not agree to this, you will get an attorney, and complain to your state's Real Estate Commission and the local Board of Realtors about the listing agent's violations of the Code of Ethics.

Good luck with this. If these are all of the facts, then you should have a good case and should get the home for the price you offered.

Ask to see the incorrect offer- you should have signed it?? Otherwise it is not an offer. I believe someone may be trying to play "games" here.

There is a LOT more to this story.

You submitted a WRITTEN offer to the bank via the listing agent. Some where along the way, your WRITTEN offer was changed.

The problem appears to be with the realtors. I would find out what happen.

Someone did something wrong here.

You can get out of the sale, because your signature is not on the offer they accepted. I am sort of confused, because the listing agent does not present over the telephone, email or anything. He either faxes or delivers a written and signed copy of the offer.

I would file a complaint with the real estate board, but that will not help you now. You will get your money back though, and likely some for your stress. They should not have had you do an appraisal before your offer was accepted and a sales contract signed either, the agent is really screwing up.

You can think of the accepted offer as a counter and decide if you are going to take it or walk.

well unfortunately just like any other job there's room for human error. it's not common but it happens. at least you are able to resubmit the offer. best wishes

You should have gotten a copy of the offer you made. When all is said and done the agent that made the "mistake" should at least pay for your appraisal. The offer you made should have been in writing and signed by you so demand a copy of it also demand a copy of the one submitted with the wrong amount. There should only be one offer, the one you signed and submitted through your agent. If the agent did something fun, such as adjusting your offer that could be considered forgery. If that is the case I would contact the DA as well as the Real Estate Board. If you are trying to seek so sort of compensation contact an attorney, not sure what you could gain?

Don't you have a lawyer? That's why you should have one when you're committing to hundreds of thousands of dollars.
I think your agent and the listing agent both either have something going on, or they are simply not doing their jobs.

You made a legal offer. The listing agent mis-read it (or changed it - for which he could lose his license).

I don't think you should stay with your agent unless he/she can get back the original offer papers and clearly explain what when wrong, why, and how it will not happen again. You have so much to lose and so much at stake.

You might also ask to speak to the agencies owner.

hmmmm................. I'd resubmit an offer (with the lower price) and a firm note that this is a FINAL offer so take it or leave it - sounds like someone is trying to get your price up - if you call their bluff - you just might get it at your price (since it sound slike your dealing with a bank short sale) - good luck

It isn't common, assuming your agent is reputable. We had a similar issue with a realtor. Just be sure that you read everything before signing, and don't sign a document with any blank spaces.
