Ella J | Realtor commission - Buyer wants cash/cut from me!? |
Hi: I am a newer realtor. I had a very demanding client above the normal. They purchased a bank repo for $285K in Southern CA which charged $100 per diem if late on COE date. The broker and I sat down and explained the entire contract with them and they signed.
The lender was six days late getting the funding. He did give them discounts for his mistake. The lender told me this, not the client. Now they are trying to get money out of me too!
Now, the buyers want me to pay out my commissions $600 to them. My commission was about $4,500 before taxes and expenses..ie gas, realtor fees, time.
Do I just right a check to make them go away? Give them a gift card to a home improvement store for $300? Ask my broker to pay a share? What is the right thing to do? I am worried if I give in them will keep coming back for more.
Any advice? My broker pretty much said too bad for them! |

I would pay it and remain "the good realtor" otherwise you are the "lazy thieving agent".

Since the lender paid them 600, you owe them nothing.
However, even if the lender HADN"T paid them 600, you still don't owe them.
It was the lender that controlled the loan, NOT THE AGENT.
The buyer is out of line and if you give them anything, it will not be enough to make them happy. |

While I don't agree with your broker's attitude, I would say they are right, especially since the lender already gave them discounts to accommodate for the additonal fees. If possible, get a written statement from the bank that shows how much the bank would have charged and how much the discount was. If it's still less than the $600 the buyer had to pay, then explain that they need to take this up with the bank that was late. Gently remind them that this was not anything that you had any control over, and therefore you don't feel it's fair that they are asking you to make up for the error on the part of the bank.
If the paperwork from the bank does show they they discounted the amount at least $600, then this should appease the buyer. If not, then you have to just chalk this customer up as one that's never going to be happy until they get it THEIR way, whether it's fair or not. |

First of all, once the house is closed, you cannot pay them anything because that is against RESPA and not only is it a felony but you could lose your license for it.
#1 rule in real estate: ALL money exchanged MUST appear on the HUD....that is federally regulated by RESPA.
Even if you recommended the lender, he was not forced to go with his lender...if his lender was late and your client got "dinged" that falls under the catagory of "too bad".
You did nothing wrong as a Realtor. The error rests with the lender and it sounds like your client was compensated.
I would stop returning his calls. Do not give him a check (I'm serious, this is a HUGE deal with the Real Estate Commission).
If he threatens to sue or file a complaint...let him...just because he files doesn't mean he's right. |
