Removing someone from my apartment who isn't on lease?

You may have an issue with this other party not being on the lease. Most lessors specify the maximum period someone can stay on the property without being a party to the lease.

Has this person been contributing to rent? If so, law enforcement may see him/her as a rightful tenant that is due appropriate notice (typically 30 days if there has been no default). If not, he/she shouldn't have any legal grounds for remaining in your apt. Even so, I doubt law enforcement will respond just because you want this person out. Law enforcement typically only gets involved when there is a filing of notice of eviction based on a legal contract.

It might get ugly if this situation has to be presented to the landlord/lessor, either by you, your cohabitant, or law enforcement. Your landlord might be within his rights to consider the presence of the other party a breach of your lease agreement and terminate the lease. If you're not on great terms with your landlord, and if rental vacancies are very low, you could find yourself looking for a new place to live as well.

It's your place. You pay the bills and your name is on the lease. Tell him he has options:

1. He can pick up his property promptly
2. He can tell you where you can deliver his property (if you so desire)
3. Tell him if his property isn't removed by a certain date, you will charge him a storage fee until he collects it.
4. If none of the above are agreeable to him, tell him his property has been carefully set outside your apartment at an available location (his relatives, his parking lot at work, on/near his vehicle, the curb). If he abandons his property at your residence and does not take the steps to claim and secure it, you should not be held responsible for its care. He has offered no consideration and should not be able to expect the same level of property protection that you receive since you are on the lease and paying the rent.

Since this might get ugly, go ahead and get your lock changed NOW if he has a key and is not likely to surrender it. Tell the landlord whatever you must, and be willing to pay for the lock change, but you want to be sure he doesn't have access.

Like someone else said, if this person is contributing to rent, they would be considered a tenant. (At least in California). Even if they are just getting bills mailed to that residence, and not even paying rent, they will be considered a resident. And residents are entitled to 30 days notice, but since you are not the landlord, you can not even give the person notice. If you call the police, they probably wont take you really seriously, because you are not the landlord. And they will not make this person leave. Also, like someone said, bringing this to the landlords attention puts you in breech of contract, unless you had an understanding with your landlord about this person living in the apartment with you. Good luck, room mates are tough situations!

The police will not force the person to leave. They are a legal occupant and must be treated as a month to month tenant by default.

Your landlord's only action would be to terminate/evict all legal occupants.

You are this person's landlord, so to speak. You must give them proper written notice to terminate their month to month tenancy. If they fail to vacate per the notice, you are going to have to evict them.

Ask the uninvited person to leave. If they refuse, call the police and tell them to remove the person from your place. In addition, if you do not want this person anywhere near you, you can tell the police you wish to get a restraining order against the person.. That way, they are court ordered not to come around you and if they do, they can be arrested.

yes, their not on the lease so technically speaking they "dont live there" so at any point in time, if needed, you can call the police to get them out,

I had that issue a while back. The landlord usually will take notice to this and they become concerned about getting the people out. If you bring it up with the landlord they will take action immediately because usually they hate having people live in their apartment that aren't on the lease. Your landlord will handle issues with the police also.
