How long is someone obligated to give you your rental deposit if you never moved in the unit? I gave a friend who i was supposed to move in with $1500 for first and last months rent.
The deal didn't go through, as she argued with me prior to move in date. It's been 8 months and I haven't seen my money. She's not the actual landlord and is just one of the main renters.
What should I do? |

Have you asked about it? Are you sure it wasn't refunded to your friend and your friend ripped you off? Contact the landlord first and inquire. If it is your friend, contact a lawyer. |

did you sign a rental, lease, or sub-lease agreement? If so, check it. If you agreed to move in for a certain period of time and then did not you may be liable for all or part of the rent for that time period. Also, you may want to check if it was even legal for her to rent to you in the first place. Many places prohibit sub-letting. Therefore, your initial agreement would be void anyway. Good luck! |

If you had an agreement to move in and for whatever reason did not move in you quite possibly lose the money. Someone had to pay the landlord, if your money went to pay the rent for the first month when you had agreed to live there then you lose.
If you had a rental agreement read it over and see if it says what would happen if you did not move in.
If you still feel that she owes you the money you need to ask for it, in writting. If she does not respond or refuses to pay or agrees to pay but does not then you should file in small claims. |

You can try taking her to small claims court but you better have some pretty good proof in order to get your money back. How about a copy of the cancelled check that says first and last months rent wrote in the memo section. |

Absolutely contact a lawyer, the Renters association in your area or small claims court. Next time don't give anyone anything without seeing, signing and approving the contract first. You have to learn to protect yourself first. |
